376 Travaux préparatoires: United Nations Convention against Transnational Organized Crimein which it was argued that article 7 should ensure that trafficked persons who had beenirregularly employed were not deprived <strong>of</strong> their rights arising from the work actually performed.It was also emphasized that adequate measures were necessary to ensure recourseto the judiciary for the trafficked persons, without the fear <strong>of</strong> potential expulsion. TheUnited Nations High Commissioner for Human Rights was <strong>of</strong> the view that paragraph 1<strong>of</strong> article 7 could be strengthened through insertion <strong>of</strong> a general provision obliging Statesparties to provide information to trafficking victims on the possibilities <strong>of</strong> obtaining remedies,including compensation for trafficking and other criminal acts, and to render reasonableassistance to such victims to obtain the remedies to which they were entitled undernational law. It was also suggested that the wording <strong>of</strong> paragraph 2 should be made moreprecise by inserting a provision to the effect that States parties were to take steps (bothindividually and through international assistance and cooperation) to provide for thephysical, psychological and social recovery <strong>of</strong> victims <strong>of</strong> trafficking. <strong>La</strong>stly, the HighCommissioner for Human Rights proposed that the term “rehabilitation” might be replacedwith terms used in the Declaration <strong>of</strong> Basic Principles <strong>of</strong> Justice for Victims <strong>of</strong> Crimeand Abuse <strong>of</strong> Power (General Assembly resolution 40/34, annex), such as “restitution”,“compensation” and “assistance” (see A/AC.254/16, paras. 22 24).8. As indicated above, in the restructured <strong>version</strong> <strong>of</strong> the draft protocol that wassubmitted by Belgium, Poland and the United States at the informal consultations heldduring the fifth session <strong>of</strong> the Ad Hoc Committee (A/AC.254/5/Add.13), paragraph 1 <strong>of</strong>article 7 was inserted in article 4 as paragraph 4. Paragraph 2 <strong>of</strong> article 7 was deleted, asit was substantially similar to subparagraph 2 (d) <strong>of</strong> article 4.
