Part One. Article 16 145rant and are urgent, and at the request <strong>of</strong> the requesting Party, take a person whoseextradition is sought and who is present in its territory into custody or take otherappropriate measures to ensure his [or her] presence at extradition proceedings. [SuchState shall immediately make a preliminary inquiry, in accordance with its own laws.]“12. Without prejudice to the exercise <strong>of</strong> any criminal jurisdiction establishedin accordance with its domestic law, a State Party in whose territory an alleged <strong>of</strong>fenderis found shall:“(a) If it does not extradite him [or her] in respect <strong>of</strong> an <strong>of</strong>fence established inaccordance with article(s) [...] [alternatively: in respect <strong>of</strong> an <strong>of</strong>fence covered by <strong>this</strong>Convention], on the grounds set forth in article [...], paragraph [...], subparagraph [...],submit the case to its competent authorities for the purpose <strong>of</strong> prosecution, unlessotherwise agreed with the requesting State Party;“(b) If it does not extradite him [or her] in respect <strong>of</strong> such an <strong>of</strong>fence and hasestablished its jurisdiction in relation to that <strong>of</strong>fence in accordance with article [...],paragraph [...], subparagraph [...], submit the case to its competent authorities for thepurpose <strong>of</strong> prosecution, unless otherwise requested by the requesting State Party forthe purposes <strong>of</strong> preserving its legitimate jurisdiction.“13. If extradition, sought for purposes <strong>of</strong> enforcing a sentence, is refusedbecause the person sought is a national <strong>of</strong> the requested State Party, the requestedParty shall, if its law so permits and in conformity with the requirements <strong>of</strong> suchlaw, upon application <strong>of</strong> the requesting Party, consider the enforcement <strong>of</strong> the sentencethat has been imposed under the law <strong>of</strong> the requesting Party, or the remainderthere<strong>of</strong>.“14. States Parties shall seek to conclude bilateral and multilateral agreementsto carry out or to enhance the effectiveness <strong>of</strong> extradition.“15. States Parties may consider entering into bilateral or multilateral agreements,whether ad hoc or general, on the transfer to their country <strong>of</strong> persons sentencedto imprisonment and other forms <strong>of</strong> deprivation <strong>of</strong> liberty for <strong>of</strong>fences to which<strong>this</strong> article applies, in order that they may complete their sentences there.“Option 1“Article 11“Obligation to extradite or prosecute (aut dedere aut judicare)“Each State Party shall take such measures as may be necessary to establish itsjurisdiction over the <strong>of</strong>fences established by <strong>this</strong> Convention, where the alleged<strong>of</strong>fender is present in its territory and, solely on the basis <strong>of</strong> the nationality <strong>of</strong> theperson sought, it does not extradite that person or conditionally extradite that personfor trial pursuant to article(s) [...] to any <strong>of</strong> the States Parties that have establishedtheir jurisdiction in accordance with <strong>this</strong> article.“Option 2“1. The State Party in the territory <strong>of</strong> which the <strong>of</strong>fender or the alleged <strong>of</strong>fenderis found, if [, solely on the basis <strong>of</strong> the nationality <strong>of</strong> the person sought,] it doesnot extradite that person or [temporarily] transfer] [conditionally extradite] that per-
