Article 27.<strong>La</strong>w enforcement cooperationA. Negotiation textsRolling text (A/AC.254/4)First session: 19-29 January 1999“Article 19 1“<strong>La</strong>w enforcement cooperation“1. States Parties shall consider entering into bilateral and multilateral agreementsor arrangements on direct cooperation between their law enforcement agencies.“2. States Parties shall cooperate closely with one another, consistent with theirrespective domestic legal and administrative systems, to enhance the effectiveness <strong>of</strong>law enforcement action to combat the <strong>of</strong>fences established in article(s) [...] [alternatively:the <strong>of</strong>fences covered by <strong>this</strong> Convention]. Each State Party shall, in particular,adopt effective measures:“(a) To establish and maintain channels <strong>of</strong> communication between their competentauthorities, agencies and services, including the designation, where appropriate,<strong>of</strong> a central authority or authorities, to facilitate the secure and rapid exchange<strong>of</strong> information concerning all aspects <strong>of</strong> the <strong>of</strong>fences established in <strong>this</strong> Convention,including, if the States Parties concerned deem it appropriate, links with other criminalactivities;“(b) To cooperate with one another in conducting inquiries, with respect to<strong>of</strong>fences established in <strong>this</strong> Convention, concerning:“(i) The identity, whereabouts and activities <strong>of</strong> persons suspected <strong>of</strong> involvementin the <strong>of</strong>fences established in <strong>this</strong> Convention;“(ii) The movement <strong>of</strong> proceeds or property derived from the commission <strong>of</strong>such <strong>of</strong>fences;“(iii) The movement <strong>of</strong> instrumentalities used or intended for use in the commission<strong>of</strong> such <strong>of</strong>fences;“(c) In appropriate cases and if not contrary to domestic law, to establish jointteams, taking into account the need to protect the security <strong>of</strong> persons and operations,in order to carry out the provisions <strong>of</strong> <strong>this</strong> paragraph. Officials <strong>of</strong> any State Party1While supporting the idea <strong>of</strong> direct law enforcement cooperation, some delegations felt that <strong>this</strong> article needed furtherconsideration in order to direct attention to its relationship with more traditional means <strong>of</strong> cooperation, such as mutuallegal assistance.235
