Each State Party shall consider establishing social policies and programmesto prevent:“(a)“(b)Trafficking in persons; andThe revictimization <strong>of</strong> trafficked persons, especially women and children.“2. States Parties [shall endeavour to]:“(a) Undertake, including through non-governmental organizations, informationcampaigns and programmes to generate public awareness <strong>of</strong> the gravity <strong>of</strong> <strong>of</strong>fences relatingto international trafficking in persons. Such programmes should include informationon potential victims, causes and consequences <strong>of</strong> such trafficking, penalties for unlawfulacts and the risks that such <strong>of</strong>fences represent to the life and health <strong>of</strong> the victims;“(b) Establish methods for gathering data and promote research to determinethe modus operandi <strong>of</strong> international trafficking in persons;“(c) Encourage, within the private sector, the establishment <strong>of</strong> pr<strong>of</strong>essional associations,foundations, non-governmental organizations and research institutes concernedwith the problem <strong>of</strong> international trafficking in persons; and“(d) Disseminate information relating to the different forms <strong>of</strong> international traffickingin persons and undertake programmed actions to combat such trafficking.“3. States Parties [shall] [are encouraged to] provide the Secretary-General <strong>of</strong>the United Nations with a list <strong>of</strong> non-governmental organizations devoted to preventingthe unlawful acts covered in <strong>this</strong> Protocol with a view to compiling a databasethat will enable the non-governmental organizations and States Parties to exchangeinformation.”Notes by the Secretariat1. At the fourth session <strong>of</strong> the Ad Hoc Committee, the Special Rapporteur on violenceagainst women, its causes and consequences submitted a position paper, in which itwas argued that the protocol should use stronger language and require States parties toundertake information campaigns and programmes to promote awareness and prevention<strong>of</strong> trafficking (see A/AC.254/CRP.13). At the same session <strong>of</strong> the Ad Hoc Committee, theUnited Nations High Commissioner for Human Rights proposed that draft article 12 shouldinclude a provision to the effect that actions aimed at preventing trafficking should nothave discriminatory effects or infringe upon the right <strong>of</strong> an individual to leave her or hiscountry or legally to migrate to another (see A/AC.254/16, para. 25). For the relevant proposalssubmitted by the <strong>International</strong> <strong>La</strong>bour Organization during the fourth session <strong>of</strong> theAd Hoc Committee (see A/AC.254/CRP.14), see note 1 by the Secretariat concerning article10 <strong>of</strong> the present protocol.
