Interpretative notesThe interpretative notes on chapter II and article 7 <strong>of</strong> the protocol approvedby the Ad Hoc Committee and contained in its report on the work <strong>of</strong> its first toeleventh sessions (see A/55/383/Add.1, paras. 98 and 99) are as follows:Chapter II. Smuggling <strong>of</strong> migrants by sea(a) It is understood that the measures set forth in chapter II <strong>of</strong> the protocolcannot be taken in the territorial sea <strong>of</strong> another State except with the permissionor authorization <strong>of</strong> the coastal State concerned. This principle is wellestablished in the law <strong>of</strong> the sea and did not need to be restated in the protocol.The international law <strong>of</strong> the sea includes the United Nations Convention on the<strong>La</strong>w <strong>of</strong> the Sea 7 as well as other relevant international instruments. References tothe United Nations Convention on the <strong>La</strong>w <strong>of</strong> the Sea do not prejudice or affectin any way the position <strong>of</strong> any State in relation to that Convention.Article 7: Cooperation(b) This protocol is without prejudice to the existing rights, obligations orresponsibilities <strong>of</strong> States parties under other international instruments, such as thosereferred to in <strong>this</strong> article. Rights, obligations and responsibilities under anotherinstrument are determined by the terms <strong>of</strong> that instrument and whether the Stateconcerned is a party to it, not by <strong>this</strong> protocol. Therefore, any State that becomesa party to <strong>this</strong> protocol but is not a party to another international instrumentreferred to in the protocol would not become subject to any right, obligation orresponsibility under that other instrument.
