Where measures taken pursuant to <strong>this</strong> Protocol prove to be unfounded,the vessel shall be compensated for any loss or damage that may have been sustained,provided that the vessel has not committed any act justifying the measures taken. 10“3. States Parties shall take, adopt or implement such measures in conformitywith international law with due regard to:“(a) The authority <strong>of</strong> the flag State to exercise jurisdiction and control in administrative,technical and social matters involving the vessel; and“(b) The rights and obligations and the exercise <strong>of</strong> jurisdiction <strong>of</strong> coastal Statesin accordance with the international law <strong>of</strong> the sea. 11“4. Any action taken at sea pursuant to articles 7 to 7 quater <strong>of</strong> <strong>this</strong> Protocol shallbe carried out only by warships or military aircraft, or by other ships or aircraft clearlymarked and identifiable as being on government service and authorized to that effect.“5. Measures taken, adopted or implemented pursuant to <strong>this</strong> Protocol shall bein conformity with international law.” 12Notes by the Secretariat2. The <strong>version</strong> <strong>of</strong> article 7 ter contained in <strong>document</strong> A/AC.254/4/Add.1/Rev.4remained unchanged in the intermediate draft <strong>of</strong> the protocol (A/AC.254/4/Add.1/Rev.5),with the exception <strong>of</strong> an editorial amendment in paragraph 1, where the words “shall makesure” replaced the words “shall ensure” and the renumbering <strong>of</strong> paragraph 2 bis, whichbecame paragraph 3. The subsequent paragraphs were renumbered accordingly.10This proposal was made by China at the sixth session <strong>of</strong> the Ad Hoc Committee (see A/AC.254/5/Add.15). The textwas taken from article 110, paragraph 3, <strong>of</strong> the United Nations Convention on the <strong>La</strong>w <strong>of</strong> the Sea (United Nations, TreatySeries, vol. 1833, No. 31363). It should be noted that references to “ship” in that text are replaced with “vessel” for consistencywith the other provisions <strong>of</strong> the draft protocol. References to unfounded “suspicions” in that text were changedbecause there was no prior reference to suspicion in <strong>this</strong> article. A similar proposal to that <strong>of</strong> China was submitted byBelgium (see A/AC.254/5/Add.21).11At the sixth session <strong>of</strong> the Ad Hoc Committee, Singapore proposed replacing the text <strong>of</strong> article 7 ter, paragraph 3,with the following text, based on article 17, paragraph 11, <strong>of</strong> the 1988 Convention:“3. Any action taken in accordance with <strong>this</strong> article shall take due account <strong>of</strong> the need not to interfere withor to affect:“(a) The rights and obligations and the exercise <strong>of</strong> jurisdiction <strong>of</strong> coastal States in accordance with the internationallaw <strong>of</strong> the sea; and“(b) The authority <strong>of</strong> the flag State to exercise jurisdiction and control in administration, technical and socialmatters involving the vessel.”At the eighth session <strong>of</strong> the Ad Hoc Committee, Singapore submitted a proposal (see A/AC.254/L.153) to insert the followingtext as a new paragraph 4 bis in article 7 ter: “No action taken pursuant to articles 7 to 7 quater <strong>of</strong> <strong>this</strong> Protocolshall be taken in the territorial sea, except with the permission <strong>of</strong> the coastal State.”12As indicated above, the language <strong>of</strong> <strong>this</strong> provision was originally derived from paragraph 5 <strong>of</strong> the interim measures.At the sixth session <strong>of</strong> the Ad Hoc Committee, the expanded reference to specific international legal instruments wasdeleted for the same reasons as given with respect to article 7, paragraph 1 (see footnote 3 concerning article 7 <strong>of</strong> the presentprotocol). Several delegations indicated a preference for the greater certainty <strong>of</strong> listing the major relevant internationallegal instruments, in particular the United Nations Convention on the <strong>La</strong>w <strong>of</strong> the Sea (United Nations, Treaty Series, vol.1833, No. 31363).
