Part One. Article 36 295European Commission (A/AC.254/L.217)Tenth session: 17-28 July 2000The European Commission proposed the following concerning article 26:1. Add the following new paragraph after paragraph 1:“(...) This Convention shall be also open for signature by regional economicintegration organizations provided that at least one member State ofsuch organization has signed the Convention in accordance with paragraph 1.”2. The following text should be added at the end of paragraph 2:“A regional economic integration organization may deposit its instrumentof ratification, acceptance or approval if at least one of its memberStates has done likewise. In this instrument of ratification, acceptance orapproval, such organization shall declare the extent of its competence withrespect to the matters governed by the Convention. Such organization shallalso inform the depositary of any relevant modification in the extent of itscompetence.”3. Paragraph 3 should be amended to read as follows:“3. This Convention is subject to accession by any State or anyregional economic integration organization of which at least one memberState is a Party to the Convention. At the time of its accession, a regionaleconomic integration organization shall declare the extent of its competencewith respect to matters governed by the Convention. The instrumentsof accession shall be deposited with the Secretary-General of the UnitedNations.”4. The words “to all States” should be replaced with the words “to all StatesParties” in paragraph 5.5. The word “States” should be replaced with the words “States Parties” inparagraph 6.Notes by the Secretariat4. At its tenth session, the Ad Hoc Committee considered, finalized and approvedarticle 26, as amended, without including a provision on reservations. The last amendmentsare reflected in the final text of the convention, as included in the report of the Ad HocCommittee (A/55/383, sect. IV, draft resolution, annex I), that was submitted to the GeneralAssembly for adoption pursuant to resolution 54/126 of 17 December 1999.
