346 Travaux préparatoires: United Nations Convention against Transnational Organized CrimeRecommendations <strong>of</strong> the informal working group on article 2 bis, submitted at therequest <strong>of</strong> the Chairperson (A/AC.254/L.248)“For the purposes <strong>of</strong> <strong>this</strong> Protocol,“Article 2 bis“Definitions“(a) ‘Trafficking in persons’ shall mean the recruitment, transportation, transfer,harbouring or receipt <strong>of</strong> persons, by means <strong>of</strong> the threat or use <strong>of</strong> force, <strong>of</strong> abduction,<strong>of</strong> fraud, <strong>of</strong> deception, <strong>of</strong> coercion, <strong>of</strong> the abuse <strong>of</strong> power or <strong>of</strong> a position <strong>of</strong>vulnerability or <strong>of</strong> the giving or receiving <strong>of</strong> payments or benefits to achieve the consent<strong>of</strong> a person having control over another person, for the purpose <strong>of</strong> exploitation.Exploitation shall include, at a minimum, the exploitation <strong>of</strong> the prostitution <strong>of</strong>others or other forms <strong>of</strong> sexual exploitation, forced labour or services, slavery orpractices similar to slavery, servitude or the removal <strong>of</strong> organs;“[(a bis) The consent <strong>of</strong> a victim <strong>of</strong> trafficking in persons to the intended exploitationset forth in subparagraph (a) shall be irrelevant where any <strong>of</strong> the means set forthin subparagraph (a) are established;]“[(b) The recruitment, transportation, transfer, harbouring or receipt <strong>of</strong> a childfor the purpose <strong>of</strong> exploitation shall be considered ‘trafficking in persons’ even if<strong>this</strong> does not involve any <strong>of</strong> the means set forth in subparagraph (a) <strong>of</strong> <strong>this</strong> article;]“(c)“(d)[Deleted.];‘Child’ shall mean any person under eighteen years <strong>of</strong> age.”Notes by the Secretariat4. At its eleventh session, the Ad Hoc Committee considered, finalized and approvedarticle 2 bis, as amended. The last amendments are reflected in the final text <strong>of</strong> the protocol,as included in the report <strong>of</strong> the Ad Hoc Committee (A/55/383, sect. IV, draft resolution,annex II), that was submitted to the General Assembly for adoption pursuant toresolution 54/126 <strong>of</strong> 17 December 1999.5. It should be noted that the representative <strong>of</strong> the Islamic Republic <strong>of</strong> Iranrequested that the report <strong>of</strong> the Ad Hoc Committee on its eleventh session should indicatethat his country had joined the consensus on article 3, subparagraph (a), <strong>of</strong> the protocol,but had registered a reservation regarding the inclusion <strong>of</strong> the expression “exploitation <strong>of</strong>the prostitution <strong>of</strong> others”. That reservation was due to inconsistency with domestic law.The representative <strong>of</strong> the United Kingdom <strong>of</strong> Great Britain and Northern Ireland statedthat his country had joined the consensus on article 3, subparagraph (b), but that it reservedits right to make an interpretative statement at the time <strong>of</strong> signing the protocol.
