346 Travaux préparatoires: United Nations Convention against Transnational Organized CrimeRecommendations of the informal working group on article 2 bis, submitted at therequest of the Chairperson (A/AC.254/L.248)“For the purposes of this Protocol,“Article 2 bis“Definitions“(a) ‘Trafficking in persons’ shall mean the recruitment, transportation, transfer,harbouring or receipt of persons, by means of the threat or use of force, of abduction,of fraud, of deception, of coercion, of the abuse of power or of a position ofvulnerability or of the giving or receiving of payments or benefits to achieve the consentof a person having control over another person, for the purpose of exploitation.Exploitation shall include, at a minimum, the exploitation of the prostitution ofothers or other forms of sexual exploitation, forced labour or services, slavery orpractices similar to slavery, servitude or the removal of organs;“[(a bis) The consent of a victim of trafficking in persons to the intended exploitationset forth in subparagraph (a) shall be irrelevant where any of the means set forthin subparagraph (a) are established;]“[(b) The recruitment, transportation, transfer, harbouring or receipt of a childfor the purpose of exploitation shall be considered ‘trafficking in persons’ even ifthis does not involve any of the means set forth in subparagraph (a) of this article;]“(c)“(d)[Deleted.];‘Child’ shall mean any person under eighteen years of age.”Notes by the Secretariat4. At its eleventh session, the Ad Hoc Committee considered, finalized and approvedarticle 2 bis, as amended. The last amendments are reflected in the final text of the protocol,as included in the report of the Ad Hoc Committee (A/55/383, sect. IV, draft resolution,annex II), that was submitted to the General Assembly for adoption pursuant toresolution 54/126 of 17 December 1999.5. It should be noted that the representative of the Islamic Republic of Iranrequested that the report of the Ad Hoc Committee on its eleventh session should indicatethat his country had joined the consensus on article 3, subparagraph (a), of the protocol,but had registered a reservation regarding the inclusion of the expression “exploitation ofthe prostitution of others”. That reservation was due to inconsistency with domestic law.The representative of the United Kingdom of Great Britain and Northern Ireland statedthat his country had joined the consensus on article 3, subparagraph (b), but that it reservedits right to make an interpretative statement at the time of signing the protocol.
