54 Travaux préparatoires: United Nations Convention against Transnational Organized CrimeNetherlands (A/AC.254/L.69)The Netherlands proposed that article 4, paragraph 1, should be amended to read asfollows:“1. Each State Party shall adopt such legislative and other measures as maybe necessary to establish as offences under its domestic law, when committed intentionally:“(a) The conversion or transfer of property, knowing or suspecting that suchproperty is the proceeds of crime, for the purpose of concealing or disguising theillicit origin of the property or of assisting any person who is involved in the commissionof the predicate offence to evade the legal consequences of his or her action;“(b) The concealment or disguise of the true nature, source, location, disposition,movement, rights with respect to or ownership of property, knowing or suspectingthat such property is the proceeds of crime; and, subject to its constitutionalprinciples and basic concepts of its legal system:[Amended placement of clause]“(c) The acquisition, possession or use of property, knowing or suspecting, atthe time of receipt [or subsequently], that such property was the proceeds of crime;“(d) Participation in, association with or conspiracy to commit, attempts to commitand aiding, abetting, facilitating and counselling the commission of any of theoffences established in accordance with this article.”Rolling text (A/AC.254/4/Rev.5)“Article 4“Laundering offences 25“1. Each State Party shall adopt, in conformity with its constitutional principles,such legislative and other measures as may be necessary to establish as offencesunder its domestic law, when committed intentionally: 26“(a) The conversion or transfer of property, knowing that such property is theproceeds of crime, for the purpose of concealing or disguising [or preventing the discoveryof] the illicit origin of the property or of helping any person who is involvedin the commission of the predicate offence to evade the legal consequences of his orher action;“(b) The concealment or disguise [or prevention of the discovery] of the truenature, source, location, disposition, movement or ownership of or rights with respectto property, knowing that such property is the proceeds of crime;25China indicated that it had difficulties of a linguistic nature with this title.26As indicated above, at the third session, Mexico had provided a definition of money-laundering (see A/AC.254/L.23).At its fifth session, the Ad Hoc Committee accepted the proposal of its Chairman that some of the elements in that definitioncould be usefully included either in the travaux préparatoires or the commentary to the convention.
