Each State Party shall take the necessary measures, including legislativeand administrative measures, in accordance with fundamental principles <strong>of</strong>its domestic law, to ensure the implementation <strong>of</strong> its obligations under <strong>this</strong>Convention.2. The <strong>of</strong>fences established in accordance with articles 5, 6, 8 and 23 <strong>of</strong><strong>this</strong> Convention shall be established in the domestic law <strong>of</strong> each State Party independently<strong>of</strong> the transnational nature or the involvement <strong>of</strong> an organized criminalgroup as described in article 3, paragraph 1, <strong>of</strong> <strong>this</strong> Convention, except to theextent that article 5 <strong>of</strong> <strong>this</strong> Convention would require the involvement <strong>of</strong> anorganized criminal group.3. Each State Party may adopt more strict or severe measures than thoseprovided for by <strong>this</strong> Convention for preventing and combating transnationalorganized crime.C. Interpretative noteThe interpretative note on article 34 <strong>of</strong> the convention approved by the AdHoc Committee and contained in its report on the work <strong>of</strong> its first to eleventhsessions (see A/55/383/Add.1, para. 59) is as follows:Paragraph 2The purpose <strong>of</strong> <strong>this</strong> paragraph is, without altering the scope <strong>of</strong> application<strong>of</strong> the convention as described in article 3, to indicate unequivocally that thetransnational element and the involvement <strong>of</strong> an organized criminal group are notto be considered elements <strong>of</strong> those <strong>of</strong>fences for criminalization purposes. The paragraphis intended to indicate to States parties that, when implementing the convention,they do not have to include in their criminalization <strong>of</strong> laundering <strong>of</strong>criminal proceeds (article 6), corruption (article 8) or obstruction <strong>of</strong> justice (article23) the elements <strong>of</strong> transnationality and involvement <strong>of</strong> an organized criminalgroup, nor in the criminalization in an organized criminal group (article 5) theelement <strong>of</strong> transnationality. This provision is furthermore intended to ensure clarityfor States parties in connection with their compliance with the criminalizationarticles <strong>of</strong> the convention and is not intended to have any impact on the interpretation<strong>of</strong> the cooperation articles <strong>of</strong> the convention (articles 16, 18 and 27).
