States Parties that have not yet done so shall 7 adopt the necessary legislationor other measures to establish as a criminal <strong>of</strong>fence [, when committed in thecontext <strong>of</strong> transnational organized crime, as defined in the Convention]: 8“(a) The intentional making, procuring or providing <strong>of</strong> a fraudulent travel oridentity <strong>document</strong>; and“(b) Knowing that a travel or identity <strong>document</strong> is fraudulent: 9“Option 2 12“(i) Using, possessing, 10 dealing with or acting on 11 such a <strong>document</strong>; and“(ii) Causing a fraudulent travel or identity <strong>document</strong> to be used, possessed,dealt with or acted on.“1. States Parties that have not yet done so shall adopt the necessary legislativeor other measures to establish the following conduct as criminal <strong>of</strong>fences whencommitted by an organized criminal group:6At the fourth session <strong>of</strong> the Ad Hoc Committee, many delegations suggested removing the square brackets so as tostress that the protocol should commit States parties to criminalizing the smuggling <strong>of</strong> illegal migrants only in the context<strong>of</strong> transnational organized crime. Other delegations preferred to retain the square brackets on the grounds that there was nodefinition <strong>of</strong> transnational organized crime in the convention.7At the fourth session <strong>of</strong> the Ad Hoc Committee, one delegation suggested replacing the word “shall” with the word“may”.8At the fourth session <strong>of</strong> the Ad Hoc Committee, many delegations suggested removing the square brackets, whilesome preferred to retain them. Several delegations suggested merging paragraph 2 with paragraph 1 <strong>of</strong> <strong>this</strong> article, whileone delegation recommended moving <strong>this</strong> paragraph to article 2. Another delegation suggested deletion <strong>of</strong> <strong>this</strong> paragraph.9At the fourth session <strong>of</strong> the Ad Hoc Committee, many delegations suggested deletion <strong>of</strong> <strong>this</strong> subparagraph, whileother delegations suggested adding the phrase “for the purpose <strong>of</strong> smuggling another person across borders”.10At the fourth session <strong>of</strong> the Ad Hoc Committee, one delegation suggested insertion <strong>of</strong> the word “trading” after theword “possessing”.11At the fourth session <strong>of</strong> the Ad Hoc Committee, one delegation suggested deletion <strong>of</strong> the words “dealing with oracting on”.12At the fourth session <strong>of</strong> the Ad Hoc Committee, South Africa suggested including <strong>this</strong> wording as an option in themain body <strong>of</strong> the text, in order to combine paragraphs 1 and 2 <strong>of</strong> the article.
