Negotiation textsFirst session: 19-29 January 1999United States <strong>of</strong> America (A/AC.254/4/Add.3)“Article 4“Victims <strong>of</strong> trafficking in persons 1“1. Each State Party shall ensure that its legislative framework contains measuresthat permit, in appropriate cases:“(a) Providing for the safe and voluntary return <strong>of</strong> victims <strong>of</strong> trafficking in personsto their countries <strong>of</strong> origin, their habitual residences or third countries;“(b)“(c)“(d)Providing victims <strong>of</strong> such trafficking access to adequate procedures to seek:“(i) Compensation for damages, including compensation coming fromfines, penalties or forfeited assets <strong>of</strong> perpetrators <strong>of</strong> such trafficking; and“(ii) Restitution from the <strong>of</strong>fenders;Providing:“(i) Information to victims <strong>of</strong> such trafficking in regard to the relevantcourt and administrative proceedings; and“(ii) Assistance to victims <strong>of</strong> crimes covered by <strong>this</strong> Protocol, enablingtheir views and concerns to be presented and considered at appropriatestages <strong>of</strong> the criminal proceedings against the <strong>of</strong>fenders, in a manner notprejudicial to the rights <strong>of</strong> the defence; andProviding appropriate housing, education and care for detained children.“2. Each State shall endeavour to provide for the physical safety <strong>of</strong> victims <strong>of</strong>trafficking in persons while they are within its territory. Each State Party shall considerimplementing the following measures:1States should consider whether <strong>this</strong> article should include a provision requiring States to accept the return <strong>of</strong> theirnationals.365
