In the case <strong>of</strong> States Parties whose legislation sets out alist <strong>of</strong> specific predicate <strong>of</strong>fences, they shall, at a minimum, include a comprehensiverange <strong>of</strong> <strong>of</strong>fences associated with organized criminal groups;“(c) For purposes <strong>of</strong> subparagraph (b), predicate <strong>of</strong>fences shall include <strong>of</strong>fencescommitted both within and outside the criminal jurisdiction <strong>of</strong> the State Party in question.However, <strong>of</strong>fences committed outside the jurisdiction <strong>of</strong> a State Party shall constitutepredicate <strong>of</strong>fences, provided that the relevant conduct is a criminal <strong>of</strong>fenceunder the law <strong>of</strong> the State where it is committed and would be a criminal <strong>of</strong>fenceunder the law <strong>of</strong> the State Party implementing or applying <strong>this</strong> article if committedthere;“(d) States Parties shall furnish copies or descriptions <strong>of</strong> their laws implementing<strong>this</strong> article to the Secretary-General <strong>of</strong> the United Nations.”Rolling text (A/AC.254/4/Rev. 8)“Article 4“Criminalization <strong>of</strong> the laundering <strong>of</strong> proceeds <strong>of</strong> crime“1. Each State Party shall adopt, in conformity with its constitutional principles,such legislative and other measures as may be necessary to establish as criminal<strong>of</strong>fences under its domestic law, when committed intentionally:“(a) The con<strong>version</strong> or transfer <strong>of</strong> property, knowing that such property is theproceeds <strong>of</strong> crime, for the purpose <strong>of</strong> concealing or disguising the illicit origin <strong>of</strong> theproperty or <strong>of</strong> helping any person who is involved in the commission <strong>of</strong> the predicate<strong>of</strong>fence to evade the legal consequences <strong>of</strong> his or her action;“(b) The concealment or disguise <strong>of</strong> the true nature, source, location, disposition,movement or ownership <strong>of</strong> or rights with respect to property, knowing that suchproperty is the proceeds <strong>of</strong> crime;“and, subject to the basic concepts <strong>of</strong> its legal system:“(c) The acquisition, possession or use <strong>of</strong> property, knowing, at the time <strong>of</strong>receipt, that such property is the proceeds <strong>of</strong> crime;“(d) Participation in, association with or conspiracy to commit, attempts to commitand aiding, abetting, facilitating and counselling the commission <strong>of</strong> any <strong>of</strong> the<strong>of</strong>fences established in accordance with <strong>this</strong> article.“2. For purposes <strong>of</strong> implementing or applying paragraph 1 <strong>of</strong> <strong>this</strong> article:“(a) States Parties shall seek to apply paragraph 1 to the widest range <strong>of</strong> predicate<strong>of</strong>fences;“(b) States Parties shall include as predicate <strong>of</strong>fences all serious crimes [asdefined in articles 2 and 2 bis] and the <strong>of</strong>fences established in articles 3, 4 ter and17 bis <strong>of</strong> <strong>this</strong> Convention. In the case <strong>of</strong> States Parties whose legislation sets out alist <strong>of</strong> specific predicate <strong>of</strong>fences, they shall, at a minimum, include a comprehensiverange <strong>of</strong> <strong>of</strong>fences associated with organized criminal groups; 4242The phrase “associated with organized criminal groups” is intended to indicate criminal activity <strong>of</strong> the type in whichorganized criminal groups engage.
