6.20.2 Scope of the Obligations Created by the CCW Protocol V on Explosive Remnantsof War. The CCW Protocol V on Explosive Remnants of War applies to explosive remnants ofwar on the land territory, including internal waters, of States that are Parties to the Protocol. 450The CCW Protocol V on Explosive Remnants of War applies to situations resulting fromarmed conflict and occupation. 451Certain obligations in the CCW Protocol V on Explosive Remnants of War only apply toexplosive remnants of war that were created after the entry into force of the Protocol for the HighContracting Party on whose territory the explosive remnants of war exist. 452 These obligationsinclude obligations discussed in:• § 6.20.3 (Taking Feasible Precautions to Protect Civilians From Explosive Remnants ofWar);• § 6.20.6 (Making Available Information on Used or Abandoned Explosive OrdnanceThat May Have Become Explosive Remnants of War);• § 6.20.7 (Clearance, Removal, or Destruction of Explosive Remnants of War FromTerritory Under a Party’s Control); and• § 6.20.8 (Providing Assistance to Facilitate the Removal of Explosive Remnants of WarFrom a Party’s Military Operations in Areas Outside Its Control).6.20.3 Taking Feasible Precautions to Protect Civilians From Explosive Remnants ofWar. Parties to the CCW Protocol V on Explosive Remnants of War and parties to an armedconflict shall take all feasible precautions in the territory under their control affected byexplosive remnants of war to protect the civilian population, individual civilians, and civilianobjects from the risks and effects of explosive remnants of war. 453Feasible precautions are those precautions that are practicable or practically possible,taking into account all circumstances ruling at the time, including humanitarian and military450 CCW PROTOCOL V ON EXPLOSIVE REMNANTS OF WAR art. 1(2) (“This Protocol shall apply to explosive remnantsof war on the land territory including internal waters of High Contracting Parties.”).451 CCW PROTOCOL V ON EXPLOSIVE REMNANTS OF WAR art. 1(3) (“This Protocol shall apply to situations resultingfrom conflicts referred to in Article 1, paragraphs 1 to 6, of the Convention, as amended on 21 December 2001.”).452 CCW PROTOCOL V ON EXPLOSIVE REMNANTS OF WAR art. 1(4) (“Articles 3, 4, 5 and 8 of this Protocol apply toexplosive remnants of war other than existing explosive remnants of war as defined in Article 2, paragraph 5 of thisProtocol.”); CCW PROTOCOL V ON EXPLOSIVE REMNANTS OF WAR art. 2(5) (“Existing explosive remnants of warmeans unexploded ordnance and abandoned explosive ordnance that existed prior to the entry into force of thisProtocol for the High Contracting Party on whose territory it exists.”).453 CCW PROTOCOL V ON EXPLOSIVE REMNANTS OF WAR art. 5(1) (“High Contracting Parties and parties to anarmed conflict shall take all feasible precautions in the territory under their control affected by explosive remnantsof war to protect the civilian population, individual civilians and civilian objects from the risks and effects ofexplosive remnants of war.”).401
