Should it prove necessary to take measures to preserve cultural property situated inoccupied territory and damaged by military operations, and should the competent nationalauthorities be unable to take such measures, the Occupying Power shall, as far as possible, and inclose co-operation with such authorities, take the most necessary measures of preservation. 36311.19.2 Respect for Cultural Property by Members of a Legitimate ResistanceMovement. Any Party to 1954 Hague Cultural Property Convention whose government isconsidered by members of a resistance movement as their legitimate government shall, ifpossible, draw the resistance movement members’ attention to the obligation to comply withthose provisions of the 1954 Hague Cultural Property Convention dealing with respect forcultural property. 36411.19.3 Special Representative for Cultural Property in Occupied Territory andApplication for Special Protection. An Occupying Power shall appoint a special representativefor cultural property situated in that territory. 365The Occupying Power is competent to submit an application for immovable culturalproperty to be entered into the International Register of Cultural Property Under SpecialProtection. 36611.19.4 Transfers of Cultural Property From and Within Occupied Territory. Therequisition of movable cultural property situated in the territory of another Party to the 1954Hague Cultural Property Convention is prohibited. 367If necessary under its obligation to take measures to preserve damaged cultural property,the Occupying Power may arrange for the transport of cultural property to a refuge withinoccupied territory in accordance with other provisions of the 1954 Hague Cultural Property363 1954 HAGUE CULTURAL PROPERTY CONVENTION art. 5(2) (“Should it prove necessary to take measures topreserve cultural property situated in occupied territory and damaged by military operations, and should thecompetent national authorities be unable to take such measures, the Occupying Power shall, as far as possible, and inclose co-operation with such authorities, take the most necessary measures of preservation.”).364 1954 HAGUE CULTURAL PROPERTY CONVENTION art. 5(3) (“Any High Contracting Party whose government isconsidered their legitimate government by members of a resistance movement, shall, if possible, draw their attentionto the obligation to comply with those provisions of the Conventions dealing with respect for cultural property.”).365 REGULATIONS FOR THE EXECUTION OF THE 1954 HAGUE CULTURAL PROPERTY CONVENTION art. 2 (“As soon asany High Contracting Party is engaged in an armed conflict to which Article 18 of the Convention applies: (a) Itshall appoint a representative for cultural property situated in its territory; if it is in occupation of another territory, itshall appoint a special representative for cultural property situated in that territory;”).366 REGULATIONS FOR THE EXECUTION OF THE 1954 HAGUE CULTURAL PROPERTY CONVENTION art. 13 (“1. AnyHigh Contracting Party may submit to the Director General of the United Nations Educational, Scientific andCultural Organization an application for the entry in the Register of certain refuges, centres containing monumentsor other immovable cultural property situated within its territory.
