present themselves for examination by the Mixed Medical Commissions provided for in Article112 of the GPW:• Wounded and sick proposed by a physician or surgeon who is of the same nationality, ora national of a party to the conflict allied with the Power on which these POWs depend,and who exercises his or her functions in the camp;• Wounded and sick proposed by their POW Representative; and• Wounded and sick proposed by the Power on which they depend, or by an organizationduly recognized by this Power and giving assistance to the POWs. 869POWs who do not belong to one of the three foregoing categories may neverthelesspresent themselves for examination by Mixed Medical Commissions, but shall be examined onlyafter those belonging to the three foregoing categories. 8709.36.5.3 Observers at the Examination. The physician or surgeon of the samenationality as the POWs who present themselves for examination by the Mixed MedicalCommission, and the POW Representative of these POWs, shall have permission to be present atthe examination. 8719.36.6 Costs of Repatriation or Transportation to a Neutral Country During Hostilities.The costs of repatriating POWs or of transporting them to a neutral country are borne, from thefrontiers of the Detaining Power, by the Power on which the POWs depend. 8729.36.7 Employment of Persons Who Have Been Repatriated. No repatriated person maybe employed on active military service. 8739.36.7.1 No Repatriated Person. The rule against employment on active militaryservice only applies to POWs repatriated by the Detaining Power pursuant to Articles 109 and869 GPW art. 113 (“Besides those who are designated by the medical authorities of the Detaining Power, wounded orsick prisoners of war belonging to the categories listed below shall be entitled to present themselves for examinationby the Mixed Medical Commissions provided for in the foregoing Article: (1) Wounded and sick proposed by aphysician or surgeon who is of the same nationality, or a national of a Party to the conflict allied with the Power onwhich the said prisoners depend, and who exercises his functions in the camp. (2) Wounded and sick proposed bytheir prisoners’ representative. (3) Wounded and sick proposed by the Power on which they depend, or by anorganization duly recognized by the said Power and giving assistance to the prisoners.”).870 GPW art. 113 (“Prisoners of war who do not belong to one of the three foregoing categories may neverthelesspresent themselves for examination by Mixed Medical Commissions, but shall be examined only after thosebelonging to the said categories.”).871 GPW art. 113 (“The physician or surgeon of the same nationality as the prisoners who present themselves forexamination by the Mixed Medical Commission, likewise the prisoners' representative of the said prisoners, shallhave permission to be present at the examination.”).872 GPW art. 116 (“The cost of repatriating prisoners of war or of transporting them to a neutral country shall beborne, from the frontiers of the Detaining Power, by the Power on which the said prisoners depend.”).873 GPW art. 117 (“No repatriated person may be employed on active military service.”).631
