corresponding interests of all other States Parties. 172 For example, States should conduct theiractivities in space with due regard for the rights of other States to have their space systems passthrough, and conduct operations in, space without interference.Article IX of the Outer Space Treaty also requires States Parties to undertake“appropriate international consultations” before proceeding with any activity or experimentplanned by it or its nationals in outer space if that State Party has reason to believe that itsactivity or experiment would cause potentially harmful interference with the activities of otherStates Parties in the peaceful exploration and use of outer space. 173 Conversely, a State Partythat has reason to believe that an activity or experiment planned by another State Party in outerspace would cause potentially harmful interference with its activities in the peaceful explorationand use of outer space may request consultation concerning the activity or experiment. 174172 OUTER SPACE TREATY art. IX (“In the exploration and use of outer space, including the moon and other celestialbodies, States Parties to the Treaty shall be guided by the principle of cooperation and mutual assistance and shallconduct all their activities in outer space, including the moon and other celestial bodies, with due regard to thecorresponding interests of all other States Parties to the Treaty.”).173 OUTER SPACE TREATY art.
