CONTRACTOR shall promptly settle all <strong>of</strong>f Right-<strong>of</strong>-Way damage claims.<br />

Should CONTRACTOR fail to do so, COMPANY shall give written notice to<br />

CONTRACTOR that if CONTRACTOR does not settle such claims within seven<br />

days after such notice, COMPANY shall have the authority to settle claims from<br />

the account <strong>of</strong> the CONTRACTOR.<br />

5.0 HANDLING, HAULING, STRINGING AND STORING OF MATERIALS.<br />

5.1 General<br />

The CONTRACTOR shall exercise utmost care in handling in pipe and other<br />

materials. CONTRACTOR shall be fully responsible for all materials and their<br />

identification until such time that the pipes and other materials are installed in<br />

permanent installation. CONTRACTOR shall be fully responsible for materials,<br />

however, method <strong>of</strong> storage shall be approved by COMPANY.<br />

CONTRACTOR shall reimburse the COMPANY for the cost <strong>of</strong> replacement <strong>of</strong><br />

all COMPANY supplied materials damaged during the period in which such<br />

materials are in the custody <strong>of</strong> the CONTRACTOR. It shall be CONTRACTOR's<br />

responsibility to unpack any packing for the materials supplied by COMPANY.<br />

5.1.2 "Taking Over" <strong>of</strong> Line Pipe<br />

The following stipulations shall apply in case CONTRACT provides for supply <strong>of</strong><br />

line pipe, bare and/or corrosion coated, by COMPANY.<br />

CONTRACTOR shall receive and 'take over' against requisition, line pipe from<br />

the COMPANY's designated place(s) <strong>of</strong> delivery as defined in the CONTRACT.<br />

CONTRACTOR shall perform visual inspection <strong>of</strong> the bare pipes and coating <strong>of</strong><br />

the corrosion coated pipes, as the case may be, in the presence <strong>of</strong> COMPANY<br />

and all damages shall be recorded. In the case <strong>of</strong> corrosion coated pipes<br />

CONTRACTOR at his option may carry out holiday detection at a prescribed set<br />

voltage and record such holidays, in the presence <strong>of</strong> COMPANY, at the time <strong>of</strong><br />

'taking over'. However, if CONTRACTOR proposes to perform only visual<br />

inspection <strong>of</strong> coating, then repair <strong>of</strong> all holidays found at the time <strong>of</strong> laying the<br />

pipeline shall be carried out by the CONTRACTOR at no extra cost to<br />

COMPANY. The CONTRACTOR shall be entitled to extra compensation for<br />

repair and rectification <strong>of</strong> defects recorded at the time <strong>of</strong> taking over as per the<br />

rate set forth in the "CONTRACT". Repair <strong>of</strong> all damages after taking over the<br />

delivery <strong>of</strong> the materials shall be to the CONTRACTOR'S cost. In case <strong>of</strong> delay<br />

in handing over <strong>of</strong> COMPANY supplied material, CONTRACTOR shall be fully<br />

responsible for stopping and rearranging means <strong>of</strong> transportation at no extra<br />

cost to the COMPANY.
