CONSULAR CONVENTION' BETWEEN THE GOVERNMENT OF<br />

THE UNION OF SOVIET SOCIALIST REPUBLICS AND THE<br />

GOVERNMENT OF THE REPUBLIC OF INDIA<br />

The Government of the Union of Soviet Socialist Republics and the<br />

Government of the Republic of India,<br />

Desirous of strengthening friendly relations existing between their two<br />

countries,<br />

Have decided to conclude a Consular Convention and for this purpose have<br />

agreed as follows:<br />

SECTION I. DEFINITIONS<br />

Article I. In this Convention the terms mentioned hereunder shall have the<br />

following meaning:<br />

a) "consular establishment" means consulate-general, consulate, viceconsulate<br />

or consular agency:<br />

b) "head of consular establishment" means consul general, consul, vice<br />

consul, or consular agent, charged with the duty of acting in that capacityc)<br />

"consular officer" means any person including the head of the consular<br />

establishment entrusted with the performance of consular functions. The term<br />

shall also include persons attached to the consular establishment for training in<br />

the consular service;<br />

d) "consular employee" means a person, not being a consular officer,<br />

performing administrative, technical, or service functions in a consular<br />

establishment;<br />

e) "consular premises" means the buildings or parts of buildings and the land<br />

ancillary thereto, irrespective of ownership, used exclusively for the purposes of<br />

the consular establishment.<br />

SECTION II. OPENING OF CONSULAR ESTABLISHMENT AND APPOINTMENT<br />

OF CONSULAR OFFICERS<br />

Article 2. I. A consular establishment may be opened by the sending State<br />

in the territory of the receiving State only with the consent of the receiving State.<br />

2. The location of a consular establishment, its status and the territorial limits<br />

of the consular district shall be determined by agreement between the sending<br />

State and the receiving State.<br />

Article 3. 1. Before the appointment of the head of a consular<br />

establishment, the sending State shall otbain the approval of the receiving State to<br />

such appointment through diplomatic channels.<br />

2. The diplomatic mission of the sending State shall send to the Ministry of<br />

External Affairs of the receiving State the commission of appointment or any other<br />

corresponding document testifying to the appointment of the head of a consular<br />
