Physical/Mental Incapacity<br />

The requirement was not within the individual’s<br />

physical or mental capacity. For purposes <strong>of</strong> this<br />

Section, the requirement was not within the physical<br />

or mental capacity <strong>of</strong> the individual if the failure,<br />

refusal, quitting or being fired from a job is due to:<br />

‣ Mental confusion.<br />

‣ Mental limitations, such as inability to read,<br />

write, understand and follow instructions.<br />

‣ Emotional disturbance.<br />

‣ Physical incapacity to participate in GROW.<br />

‣ Mistake or inadvertence, as opposed to<br />

willfulness.<br />

‣ Circumstances beyond the person’s<br />

reasonable control.<br />

‣ Other unusual or compelling facts presented<br />

by the individual that, under the<br />

circumstances <strong>of</strong> the case, must reasonably<br />

be viewed as good cause for failure to<br />

comply.<br />

Verification <strong>of</strong> physical/mental incapacity:<br />

Observation by DPSS or DMH/APS staff <strong>of</strong> current<br />

behavior that may have resulted in a job<br />

quit/dismissal or a description <strong>of</strong> the circumstances<br />

on a PA 853 completed by the individual. The<br />

EW/Hearing Officer/GROW Case Manager may<br />

require corroboration by third party evidence.<br />

Follow-up: Depending on the physical or mental<br />

limitations <strong>of</strong> an individual, a change <strong>of</strong> GROW<br />

assignment may be necessary or a very clear<br />

review <strong>of</strong> the requirements may be sufficient. If not,<br />

a referral for employability screening or mental<br />

health evaluation is made to determine the<br />

employability status.<br />
