GR 44-120.1 – Appeal<br />

for SSI/SSP or RSDHI If SSI/SSP or <strong>Social</strong> Security (RSDHI) is<br />

terminated, is the individual required to file an<br />

appeal?<br />

Yes, former SSI/SSP or <strong>Social</strong> Security recipients<br />

have 60 calendar days immediately following<br />

termination <strong>of</strong> such benefits to appeal at the SSA.<br />

Not Filed<br />

Is the individual eligible to GR if an appeal has<br />

not been filed?<br />

No, unemployable individuals are not eligible to GR<br />

until one <strong>of</strong> the following events occurs:<br />

• The individual/parent has filed an appeal at<br />

SSA.<br />

Refer to GR 44-119 for SSA referral information.<br />

• The 60 day filing period has ended and the<br />

individual has reapplied for the terminated<br />

benefits.<br />

If the application is for SSI, the individual is referred<br />

to the SSI Advocate to file an appeal.<br />

Should an appeal be filed when individuals<br />

reapply for terminated benefits without filing an<br />

appeal and are subsequently denied?<br />

Yes, an appeal must also be filed if SSI/SSP or<br />

RSDHI benefits are subsequently denied.<br />

GR 44-120.4 – Formerly<br />

Received Benefits Are employable individuals who formerly<br />

received SSI/SSP or RSDHI required to appeal,<br />

request continued benefits, or reapply for the<br />

terminated benefits?<br />

Individuals who are still disabled must appeal,<br />

request continued benefits, or reapply for SSI/SSP<br />

or RSDHI benefits. However, employable<br />

individuals previously denied/terminated benefits<br />

because they were not disable dare not required to
