Referrals for<br />

Undocumented Aliens<br />

Are referrals to USCIS ever made for<br />

undocumented aliens?<br />

Yes, if an undocumented alien claims to be either a<br />

lawful permanent resident or an immigrant authorized<br />

to remain indefinitely in the U.S., or has no/cannot<br />

remember his/her alien number, a G-845 SAVE,<br />

USCIS/INS Document Verification Request, is sent by<br />

the worker, to USCIS. A 30 day future action control<br />

(FAC), is set for return <strong>of</strong> the G-845 SAVE to establish<br />

the individual’s U.S. resident status. This control does<br />

not reduce or extend the time limit on the application<br />

process.<br />

GR 42-409 – Return to<br />

Residence/Aid to Nonresidents<br />

GR 42-409.1 – Criteria:<br />

Return to Residence<br />

Can aid be given to a nonresident who wishes to<br />

return to his/her legal residence?<br />

Yes, aid may be granted to cover all necessary<br />

expenses for returning a nonresident indigent to<br />

another county, State or country, if it is determined<br />

that such county, State or country, is the person’s<br />

legal residence, but only when all other GR<br />

requirements, other than intent to reside, are met.<br />

What criteria must be met?<br />

In addition to the GR requirements, the following<br />

criteria must be met before aid for return to residence<br />

can be issued:<br />

• The legal residence to which the nonresident is to<br />

be returned must be determined by evaluating the<br />

following:<br />

‣ Amount <strong>of</strong> time spent in the county/State/<br />

country, versus amount <strong>of</strong> time spent outside<br />

<strong>of</strong> the county/State/country.<br />

‣ The place where he/she and family (spouse,<br />

children and/or social ties) has established<br />

their residence, not merely for a special or<br />

limited purpose, but with a present intention <strong>of</strong><br />

making it his/her true, fixed permanent and<br />

principal residence.<br />

‣ Location where the Driver’s License or ID was<br />

issued.
