‣ When either the deemed or contribution<br />

amount equals or exceeds the GR grant<br />

amount, GR is denied/terminated for<br />

excess income.<br />

‣ When the resources for the alien or the<br />

sponsor exceed the maximum resources<br />

allowable, GR is denied/terminated for<br />

excess personal property.<br />

‣ Using the above information, the sponsored<br />

alien’s eligibility to GR is determined.<br />

Deeming Formula<br />

What is the deeming formula?<br />

The deeming formula is provided on the ABP 1074<br />

and is used to determine the amount available to the<br />

sponsored alien. The information obtained on the<br />

ABP 1073 is entered on the ABP 1074.<br />

• When a sponsor is providing support for two or<br />

more aliens on more than one case, the deemed<br />

income amount, if any, is divided by the total<br />

number <strong>of</strong> aliens sponsored. The divided share<br />

becomes the sponsored alien’s deemed income<br />

amount.<br />

• The deemed income amount is treated as<br />

unearned income for the duration <strong>of</strong> the<br />

sponsorship period (see GR 43-205.4). Each time<br />

a sponsor reports a change in support<br />

circumstances, a new determination is made.<br />

• Using the deeming formula, eligibility to GR is<br />

determined.<br />

Are sponsored alien cases referred for<br />

collection?<br />

Yes, because a sponsor signs as Affidavit <strong>of</strong> Support<br />

agreeing to support, he/she is obligated to reimburse<br />

and GR paid to the sponsored alien during the<br />

sponsorship period.<br />
