What is real property?<br />

Real property is described as land and<br />

improvements, including but not limited to, houses,<br />

apartments, commercial buildings, trees and fences.<br />

Also to be evaluated as real property is property<br />

currently in escrow as part <strong>of</strong> an estate or patented<br />

(e.g., timber or mining rights).<br />

What is personal property?<br />

Personal property is described as “belongings” or<br />

interests in belongings, which may be easily<br />

transported or stored (e.g., stocks, savings bonds,<br />

etc.). Personal property may also be a valuable right,<br />

such as an unpaid debt.<br />

How is the owner <strong>of</strong> property determined?<br />

The owner <strong>of</strong> property is the person who holds legal<br />

title to the property except:<br />

• When title is held only for convenience and the<br />

individual has no right to receive the proceeds<br />

from the sale <strong>of</strong> the property.<br />

EXAMPLE:<br />

The actual owner <strong>of</strong> an apartment complex is out<br />

<strong>of</strong> the state and has asked the individual to<br />

manage the property.<br />

• When legal title to property is given up for<br />

convenience, the person giving up title is<br />

considered the owner <strong>of</strong> the property.<br />

EXAMPLE:<br />

The individual transfers property to his or her<br />

brother, so that the brother can sell it. However,<br />

the actual owner is still the individual and he<br />

would receive the proceeds <strong>of</strong> the sale.<br />
