DIB Claim<br />

If the DIB claim is denied, is the individual<br />

required to file an appeal?<br />

Yes, individuals must be advised at the time <strong>of</strong><br />

referral to apply for DIB that a denied DIB<br />

application must be appealed within 20 days <strong>of</strong> the<br />

date <strong>of</strong> the notice <strong>of</strong> denial <strong>of</strong> benefits if the<br />

individual disagrees with the reason for denial.<br />

Verification <strong>of</strong> DIB<br />

Denial/Appeal<br />

Verification: The DE 2517-C, Notice <strong>of</strong><br />

Determination, or the DE 429D/DE 429 R, Disability<br />

Insurance – Notice <strong>of</strong> Computation, may be used to<br />

document that the individual’s DIB claim has been<br />

denied and the reason for denial.<br />

• The individual will receive a “California<br />

Unemployment Insurance Appeals Award –<br />

Notice <strong>of</strong> Hearing”, from EDD within 3-4 weeks<br />

<strong>of</strong> filing the DIB appeal and at least 10 days prior<br />

to the appeal hearing date. The appeals section<br />

<strong>of</strong> EDD will hear the case within 30 days from<br />

the date the appeal is filed. A decision will be<br />

issued in writing to the individual within 10 days<br />

after the hearing.<br />

• If the individual has already filed a DIB appeal,<br />

the individual must obtain written pro<strong>of</strong> from<br />

EDD that an appeal is pending.<br />

• Copies <strong>of</strong> the documents indicated above or a<br />

record in Case Comments <strong>of</strong> what document<br />

was seen along with the date the verification is<br />

seen and all pertinent information such as the<br />

award/denial/appeal data.<br />

• The individual is referred to EDD with a PA 30 to<br />

file an appeal <strong>of</strong> DIB denial, when appropriate.<br />

The individual must request EDD staff to stamp<br />

and initial the PA 30 and note the date the<br />

appeal was filed.<br />

• The reason an individual is not required to file an<br />

appeal <strong>of</strong> DIB denial is recorded in the Case<br />

Comments.
