Misses Hearing<br />

What happens when an individual misses a<br />

hearing?<br />

Affidavits are provided to individuals who indicate<br />

they missed their hearing because <strong>of</strong> delayed or<br />

non-receipt <strong>of</strong> a NOA.<br />

NOTE: If the hearing was missed for another<br />

reason, the non-compliance issue can<br />

still be resolved any time during<br />

extended suspend.<br />

Refer to GR 44-411 for details on extended<br />

suspend.<br />

Affidavits are accepted up to the last day <strong>of</strong> the<br />

extended suspend period (the third Thursday<br />

following the effective date <strong>of</strong> termination).<br />

Upon submission <strong>of</strong> such an affidavit, a hearing is<br />

held on the same or next working day.<br />

When either <strong>of</strong> these dates is inconvenient for the<br />

individual, another mutually acceptable hearing<br />

date is scheduled. This date must fall within five<br />

calendar days <strong>of</strong> the affidavit submission and on<br />

or before the last day <strong>of</strong> the extended suspend<br />

period.<br />

NOTE: Hearings are not held after the last day<br />

<strong>of</strong> the extended suspend period.<br />

Same-day hearings must be held when:<br />

An affidavit is submitted on the last day <strong>of</strong> the<br />

extended suspend period.<br />

QR 7 is complete/submitted and the individual is<br />

homeless/threatened with homelessness.<br />

Benefits are reinstated without penalty or<br />

proration when issues are resolved or good<br />

cause is established.
