GR 44-216.1 Ineligibility Are individuals who are in jail eligible for GR?<br />

No, individuals who are in jail are not eligible for GR.<br />

Individual Enters Jail<br />

What happens when an individual in an approved<br />

case enters jail?<br />

• Aid is discontinued effective the end <strong>of</strong> the month<br />

in which the individual entered jail.<br />

• Overpayments are adjusted for any issuance<br />

occurring beginning the first day <strong>of</strong> the month<br />

following the date the individual entered jail.<br />

GR 44-216.4 Jail Match<br />

Verification <strong>of</strong> release date: The release date is<br />

verified by viewing release documents, or, if the<br />

individual does not have release documents, by<br />

obtaining the individual’s sworn affidavit.<br />

Is there a jail match process?<br />

Yes, a match is completed by the Welfare Fraud<br />

Prevention & Investigation (WFP&I) Section. WFP&I<br />

notifies districts <strong>of</strong> needed action.<br />

GR 44-216.5 Rescind<br />

Aid When Released<br />

from Jail<br />

When an individual is released from jail, can aid<br />

be rescinded?<br />

Yes, if the individual has release papers, aid is<br />

rescinded effective the date <strong>of</strong> the release or the first<br />

<strong>of</strong> the month after the termination date, whichever is<br />

later.<br />

EXAMPLE:<br />

Aid is terminated effective September 30. The<br />

individual comes to the district <strong>of</strong>fice on October 5<br />

with release papers showing release from jail on<br />

October 4. Rescind aid effective October 4.<br />
