Workers must exercise judgment to determine if the<br />

NSA applicant/participant has the mental capacity<br />

to understand the affidavit and the situation<br />

requiring the use <strong>of</strong> the affidavit. If there is<br />

uncertainty regarding the NSA applicant’s/<br />

participant’s capacity to understand and complete<br />

the affidavit, the co-located DMH/APS Screener or<br />

the Deputy District Director should be consulted in<br />

making the determination <strong>of</strong> the NSA applicant’s/<br />

participant’s mental capacity.<br />

Specialized NSA Files<br />

If it is determined that the NSA applicant/participant<br />

appears to be unable to complete the affidavit, the<br />

EW must determine, based on GR <strong>Policy</strong> 41-105, if<br />

the GR eligibility requirement for which the affidavit<br />

was being sought may be deferred.<br />

Are NSA cases assigned to Specialized<br />

Workers?<br />

Yes, NSA cases are specialized in at least one<br />

intake and one approved file. Additional files are<br />

also designated, as needed, to ensure backup<br />

coverage and to accommodate NSA caseloads.<br />

The District Director (DD) assigns Workers who<br />

have an interest in, and are sensitive to, mentally<br />

disabled GR individuals to the specialized NSA<br />

files. Recommendations for Workers may be<br />

solicited from the co-located DMH/APS staff.<br />

Case in a Regular File<br />

An individual, in a regular intake or approved<br />

file is identified as potentially NSA, what needs<br />

to be done?<br />

• Individuals in a regular intake or approved file<br />

who are identified as potentially NSA, are<br />

referred to the DMH/APS staff for a mental<br />

health evaluation.<br />

• If the individual is determined by DMH/APS staff<br />

or the Deputy District Director (DDD) to NSA,<br />

the case is immediately transferred to a<br />

designated NSA intake or approved file.<br />

What is the ABP 597 used for?<br />

• The out <strong>of</strong> drawer ABP 597, Determination <strong>of</strong><br />

Needs Special Assistance or Administratively<br />

Unemployable Status, is completed whenever<br />

an individual’s employability status changes to<br />

NSA.
