Yes, individuals whose continued <strong>Social</strong> security<br />

(RSDHI) benefits are less than the grant are eligible<br />

to GR.<br />

GR 44-120.10 – Filing<br />

Appeal for SSI/SSP or<br />

RSDHI<br />

How do individuals file an appeal for SSI/SSP or<br />

RSDHI benefits?<br />

Individuals are referred to SSA to appeal using the<br />

SSA 1610, as follows:<br />

• Prepare the form in triplicate according to the<br />

instructions on the back <strong>of</strong> the form.<br />

• In “REMARKS” (Section 5), enter: “Please state<br />

date and type <strong>of</strong> appeal filed or reason for not<br />

filing for (individual’s name).”<br />

• For SSI, the individual is referred to the SSI<br />

Advocate.<br />

• Advise the individual to take the original and first<br />

copy <strong>of</strong> the SSA 1610 to the SSA <strong>of</strong>fice along<br />

with the discontinuance notice received from<br />

SSA.<br />

• Advise the individual to have the SSA 1610<br />

signed and dated by an SSA Representative<br />

and return the original to the district <strong>of</strong>fice within<br />

10 workdays. The SSA representative will keep<br />

the copy <strong>of</strong> the SSA 1610.<br />

• The FAC is set up to control the return <strong>of</strong> the<br />

SSA 1610.<br />

• The SSA 1610 is prepared in duplicate<br />

according to the instructions on the back <strong>of</strong> the<br />

form.
