How does the individual know if a claim has<br />

been denied?<br />

The DE 1080, Notice <strong>of</strong> Determination, is sent to<br />

the individual to document that a UIB claim has<br />

been denied and the reason for denial.<br />

Verification: The individual receives a “California<br />

Unemployment Insurance Appeals Award – Notice<br />

<strong>of</strong> Hearing,” from EDD within 3-4 weeks <strong>of</strong> filing the<br />

UIB appeal and at least 10 days prior to the appeal<br />

hearing date. The appeals section <strong>of</strong> EDD will hear<br />

the case within 30 days from the date the appeal is<br />

filed. A decision will be issued in writing to the<br />

individual within 10 days after the hearing.<br />

• The Worker records in Case Comments that the<br />

“California Unemployment Insurance Appeals<br />

Award – Notice <strong>of</strong> Hearing” letter was seen<br />

along with the date the verification is seen and<br />

all pertinent information such as the<br />

award/denial/appeal data.<br />

• The Worker refers the individual to EDD with a<br />

PA 30, Reference Slip, (an out <strong>of</strong> drawer form)<br />

to file an appeal <strong>of</strong> UIB denial, when<br />

appropriate. The individual must request EDD<br />

staff to stamp and initial the PA 30, and note the<br />

date the appeal was filed.<br />

• If the individual is not required to file an appeal,<br />

the reason must be recorded in Case<br />

Comments.<br />
