Overpayment<br />

he has used only two months <strong>of</strong> his five months <strong>of</strong><br />

eligibility as an employable. He does not reapply<br />

for aid again until December 31, 2003. His 365-day<br />

time limit period expires January 31, 2004.<br />

However, the new time period will be reset and<br />

begin counting the next 277 days through January<br />

31, 2005.<br />

What happens when an overpayment occurs as<br />

the result <strong>of</strong> the employability status changing<br />

to employable and the individual is time-limited<br />

<strong>of</strong>f aid in the same month?<br />

LEADER tracks the number <strong>of</strong> days an employable<br />

individual is eligible and will terminate aid when that<br />

time limit is reached. However, when an<br />

individual’s classification changes from<br />

Unemployable, NSA or Administratively<br />

Unemployable to employable (after the grant is<br />

issued for the month) and eligibility as an<br />

employable individual expires during that same<br />

month, the individual is not entitled to the entire<br />

month’s benefits. In this case, LEADER calculates<br />

an overpayment.<br />

EXAMPLE:<br />

An individual is unemployable on September 1,<br />

2003 and received $221 for the month. On<br />

September 10, 2003, the employability status<br />

changed to employable and there is only five days<br />

<strong>of</strong> eligibility as an Employable remaining. At the<br />

end <strong>of</strong> the five days, aid is automatically terminated<br />

effective September 15, 2003. LEADER calculates<br />

the overpayment for the period September 16, 2003<br />

through September 30, 2003.<br />

Is denial/termination automated on LEADER?<br />

Yes, LEADER automatically denies/terminates aid<br />

for time limits; however, Food Stamps eligibility<br />

must be determined separately.<br />

What should be done when an individual has<br />

been terminated for time limits and a<br />

overpayment that results in a period <strong>of</strong><br />

ineligibility is discovered before the next<br />

eligibility date?<br />

The overpayment and time-limits will run<br />

concurrently.<br />
