Cause Determination<br />

Is a good cause determination necessary for<br />

non-compliance with MSARP requirements?<br />

Yes, as with employable requirements, good cause<br />

is determined for non-compliance with MSARP.<br />

The ABP 1170, Substance Abuse Recovery<br />

Program & Good Cause determination, (an out <strong>of</strong><br />

drawer form) is used in determining good cause.<br />

When is a good cause determination made prior<br />

to the denial/termination?<br />

A good cause determination must be made before a<br />

case is denied/terminated when an individual<br />

contacts the Worker by phone, in writing, or I<br />

person:<br />

Prior to or at the time <strong>of</strong> denial,<br />

Prior to the hearing or<br />

At the hearing.<br />

Non-compliance Issues<br />

When there is a good cause, when is aid<br />

rescinded?<br />

When good cause has been determined, the<br />

denial/termination is rescinded effective the<br />

beginning <strong>of</strong> the month after the date <strong>of</strong> termination<br />

or, for intake, the approval process continues.<br />

When is a good cause determination made, after<br />

the denial/termination or at Intake?<br />

A good cause determination must be made after the<br />

denial/termination when the individual contacts the<br />

EW by phone, in writing or in person. If good cause<br />

is determined, the denial/termination is rescinded<br />

effective the beginning <strong>of</strong> the month after the date<br />

<strong>of</strong> termination or, for intake, aid is approved<br />

effective the date <strong>of</strong> application (previously denied).<br />

What needs to be done when an individual fails<br />

to comply with MSARP and fails to comply with<br />

employable requirements in the same month?<br />

When an individual fails to comply with MSARP<br />

requirements in the same month that they fail to<br />

comply with employable requirements:<br />

A separate NOA is sent out for each noncompliance,<br />

providing both the sanction and a<br />

hearing date for each incident.
