Benefits must be issued on-line the same day for<br />

individuals who have resolved all outstanding<br />

non-compliance issues and are homeless and or<br />

threatened with homelessness.<br />

Rescheduled Hearings<br />

Individual’s Request<br />

When are hearings rescheduled when requested<br />

by the individual?<br />

The hearing is rescheduled when an individual<br />

advises the Worker in advance <strong>of</strong> the hearing <strong>of</strong> not<br />

being able to attend the hearing for a legitimate<br />

reason.<br />

The hearing is rescheduled to a mutually<br />

acceptable date that falls before the individual’s<br />

next stagger date (when possible), provided this<br />

date falls on or before the last date <strong>of</strong> the<br />

extended suspend.<br />

If it is not possible to reschedule the hearing<br />

before the next stagger date, the hearing is<br />

scheduled within one week <strong>of</strong> the request to<br />

reschedule.<br />

If the individual advises the Worker in advance <strong>of</strong><br />

not being able to attend the rescheduled hearing,<br />

for a legitimate reason, it can be rescheduled<br />

again. The second reschedule must be within the<br />

week <strong>of</strong> the original request to reschedule.<br />

No benefits can be issued pending resolution <strong>of</strong><br />

the hearing issue.<br />

When good cause is determined, benefits are<br />

increased/rescinded without penalty or proration.<br />

County’s Request<br />

When are hearings rescheduled at the county’s<br />

request?<br />

When the hearing is rescheduled by the County to a<br />

date on or after the individual’s stagger date, aid is<br />

not reduced or suspended pending the hearing.<br />

If aid has already been reduced/suspended, benefits<br />

must be increased/rescinded, without penalty or<br />

proration and be available on the individual’s stagger<br />

date.
