Most pre-termination hearings are scheduled for the<br />

last day <strong>of</strong> eligibility to GR, or the last workday prior<br />

to case termination. The exception is when<br />

individuals have less than ten days <strong>of</strong> eligibility, in<br />

which case the hearing is scheduled ten days from<br />

the date aid is approved or change action takes<br />

place.<br />

The ABP 1198, GR Time Limits Action<br />

Required, (an out <strong>of</strong> drawer from) is used by the<br />

Hearing Officer to advise the Worker <strong>of</strong> any<br />

action required as the result <strong>of</strong> the hearing.<br />

What happens when a time limited individual<br />

declares he/she is not employable?<br />

Individuals who declare they are not employable are<br />

referred for an employability screening, mental<br />

health evaluation or evaluation for Administratively<br />

Unemployable status, as appropriate.<br />

If found to be Unemployable, NSA or<br />

Administratively Unemployable, GR is approved<br />

effective the date following the date <strong>of</strong> time limits<br />

termination.<br />

GR 40-121.7 – Couple<br />

Case<br />

When one individual in a couple case reaches<br />

his/her time limit, is the entire case terminated?<br />

No, for couple cases, once the first adult reaches<br />

the maximum number <strong>of</strong> eligible days, that person<br />

is automatically removed form the case. Once the<br />

second adult reaches his/her time limit, the case is<br />

terminated.<br />

Extended Suspend<br />

What happens when time limits expire during<br />

the extended suspend period?<br />

There may be situations where GR is terminated for<br />

non-compliance and the individual complies during<br />

the extended suspend period, but the case is time<br />

limited during extended suspend. In these cases:<br />

The individual is eligible to a prorated grant up to<br />

the 277 th day <strong>of</strong> employable eligibility. If the noncompliance<br />

issue is not resolved, the individual will<br />

receive no benefits and GR is terminated for the<br />

non-compliance reason.
