GR 42-204 – Property Items to be Evaluated GR 42-204.1 – Evaluate Real Property What real property needs to be evaluated? In addition to the property described in GR 42-201, the following are evaluated as real property and subject to property limits. • Real property being bought or sold under contract of sale. • Real property being bought or sold while held in escrow. • Real property held in trust, if it is available for sale, transfer, or use. • Real property in an undistributed estate, if it is available for use. • Patented or unpatented mining claims, timber (standing), oil or mineral rights. GR 42-204.2 – Evaluate Personal Property What personal property needs to be evaluated? In addition to the items described in GR 42-201, the following must be evaluated. This includes items for which the individual is still making loan payments: • Crypts or niches held for profit. In other words, not held for the personal use of the individual. • Cash surrender value of life insurance on the life of the individual. • Motor vehicles, cars, trucks, motorcycles, motorbikes, motor scooters, mopeds, minibikes, dune buggies, electric cars, etc. • Value of stocks and bonds. • Motor homes, campers, house trailers, boats, etc., when not used as a home. • Mobile homes.
• Any other property not classified as real property. Credit Card Are credit cards counted in determining property limits? No, credit cards are not considered property or resources. GR 42-205 – Community Property GR 42-205.1 – Definition What is Community property? Community property (real or personal) is property obtained by spouses during marriage (unless obtained as separate property), as described in GR 42-206 below. Community property includes property purchases with: • community funds, • funds recovered from the sale of community property, or • personal credit of either spouse. Property purchased with funds that cannot be identified as separate property is considered community property. GR 42-205.2 – Ownership of Community Property How is ownership of community property determined? Each spouse is presumed to own a one-half interest in community property, regardless of which spouse has the property. All property held in the name of the spouse is presumed to be community property unless evidence establishes it to be separate property. See GR 42-206 for definitions of separate property.
