Adult individuals are entitled to own property<br />

within the GR property limitations.<br />

EXAMPLE:<br />

When an adult brother and sister live together,<br />

each is entitled to both the real and personal<br />

property limitations separately according to the<br />

standards in this chapter.<br />

• Families<br />

Spouses, including common-law relationships<br />

recognized by other states, their minor children,<br />

and 18 year olds attending high school or trade<br />

school, are entitled to own property within the GR<br />

property limits for families as spelled out in this<br />

chapter. Spouses without minor children are also<br />

to be treated as family.<br />

What is the transfer <strong>of</strong> property?<br />

A transfer <strong>of</strong> property is defined as property sold or<br />

given away, in whole or in part.<br />

If an individual transfers property, how is the case<br />

affected?<br />

It is presumed that a voluntary transfer <strong>of</strong> real or<br />

personal property made within two years prior to<br />

application for GR was made for the purpose <strong>of</strong><br />

qualifying for GR. It is also presumed that a voluntary<br />

transfer <strong>of</strong> real or personal property made while<br />

receiving GR was made for the purpose <strong>of</strong> avoiding<br />

repayment <strong>of</strong> aid. However, the individual is provided<br />

an opportunity to rebut such a presumption.<br />

• When the total value <strong>of</strong> the transferred property,<br />

plus the total value <strong>of</strong> other real/personal property<br />

owned at the time <strong>of</strong> the transfer or subsequently,<br />

is less than limits in this chapter, the transfer is<br />

not presumed to have been made for the purpose<br />

<strong>of</strong> qualifying for GR or to avoid repayment <strong>of</strong> aid.<br />
