• I-134<br />

The old Affidavit (I-134) was in effect prior to<br />

December 19, 1997. It required sponsors to<br />

support the alien for a period <strong>of</strong> three years.<br />

• I-864<br />

The new Affidavit (I-864) became effective<br />

December 19, 1997. If requires sponsors to<br />

support the immigrant until he/she becomes a<br />

naturalized citizen or can be credited with 40<br />

qualifying quarters <strong>of</strong> work.<br />

NOTE: It is possible that some immigrants entered<br />

the United States for a period <strong>of</strong> time after<br />

December 19, 1997 under the old Affidavit.<br />

GR 43-201.5 – Copy <strong>of</strong><br />

I-134 and/or I-864<br />

Is the sponsored alien required to provide a copy<br />

<strong>of</strong> the I-134/I-864?<br />

No, the sponsored alien is not required to provide a<br />

copy <strong>of</strong> the I-134/I-864 as a condition <strong>of</strong> aid.<br />

However, if available, the Affidavit should be obtained<br />

as it assists in any collection activities. In the<br />

absence <strong>of</strong> an Affidavit, the date <strong>of</strong> entry must be<br />

used to determine the sponsorship period.<br />

What needs to be done when the sponsorship<br />

period has expired?<br />

When the sponsorship period, as determined by<br />

LEADER, has expired:<br />

• For adult cases, no further action is required.<br />

The case is no longer considered a sponsored<br />

alien case. Deeming is no longer required.<br />

• For family cases, <strong>General</strong> <strong>Relief</strong> (GR) is<br />

terminated and the individuals are referred to<br />

apply for CalWORKs.<br />

All aliens applying for GR are assumed to sponsored<br />

unless they are exempt as described in 43-201<br />
