An individual and his brother own property. The<br />

individual paid 10% <strong>of</strong> the purchase price and his<br />

brother paid 90%. It could be accepted that they do<br />

not have equal rights to possess, control, and use the<br />

property. In this instance, 10% <strong>of</strong> the value <strong>of</strong> the<br />

property is considered for property limitations.<br />

• A victim <strong>of</strong> domestic violence or “battered”<br />

individual who shares title is exempt from this<br />

presumption when:<br />

‣ Title shared is in the home the domestic<br />

violence or “battered” individual left.<br />

‣ The spouse/other titleholder remains in the<br />

home.<br />

Can an individual who has real property used as a<br />

home be eligible?<br />

Yes, individuals may be eligible to GR and keep one<br />

piece <strong>of</strong> real property used as a home, whether<br />

owned by themselves or with others, if the assessed<br />

value is $34,000 or less.<br />

Individuals may retain real property not used as a<br />

home if the assessed value is $34,000 or less,<br />

subject to the lien requirements.<br />

liens.<br />

How is ownership and value <strong>of</strong> real property<br />

located in Los Angeles County verified?<br />

• The most recent tax statement is reviewed.<br />

• If the tax statement is not available, the Property<br />

<strong>Services</strong> Section is contacted to obtain the<br />

assessed value. The information obtained in the<br />

telephone contact is documented in the Case<br />

Comments Section.<br />
