• Aid to prevent eviction/foreclosure has not been<br />

issued to the individual within the past year.<br />

The individual has received a written notice <strong>of</strong> intent<br />

to evict/foreclose from the landlord or mortgage<br />

holder. Notice by a marshal or Notice <strong>of</strong> Default is<br />

not required. The notice must specify the time period<br />

for which:<br />

• Payment is due, the amount due and deadline for<br />

payment.<br />

• The amount due (or the amount the landlord will<br />

accept) plus any amount issued for utilities must<br />

be within the maximum allowed for housing.<br />

Refer to GR 44-201 for the Basic Budget Table.<br />

• In shared living situations, only the individual’s<br />

prorated share may be allowed and is not allowed<br />

if the other household members cannot meet their<br />

share <strong>of</strong> the cost.<br />

• The landlord/mortgage holder agrees not to<br />

evict/foreclose if the rent/mortgage or agreed<br />

upon portion is paid. Acceptance <strong>of</strong> a partial<br />

payment generally nullifies the preceding notice.<br />

• In situations involving foreclosure, a lien must be<br />

signed by the individual, although it may not have<br />

been recorded.<br />

• Any amounts issued for the current month are<br />

deducted as part <strong>of</strong> the GR grant for the same<br />

month.<br />

EXAMPLE:<br />

An individual applies for GR August 1 and has a<br />

notice <strong>of</strong> eviction dated July 10 advising payment <strong>of</strong><br />

$100 is due by July 31. The landlord has agreed to<br />

waive eviction if he receives full payment by August 5<br />

for both July and August rent ($100 for each month).<br />

Because this is his first request for such aid and other<br />

criteria described above have been met, the<br />

individual is eligible for emergency aid for July and<br />

August.<br />

In this example, as the $100 needed for rent is less<br />

than the $136 allowed for rent in the Basic Budget
