HERBERT SMITH PRIZE IN THE CONFLICT OF LAWS<br />
1. The sum made available annually by Messrs Herbert Smith shall be used to provide a prize called<br />
<strong>the</strong> Herbert Smith Prize in <strong>the</strong> Conflict <strong>of</strong> Laws.<br />
2. The Prize shall be awarded by <strong>the</strong> Examiners for Part II <strong>of</strong> <strong>the</strong> Law Tripos to <strong>the</strong> candidate who<br />
has shown <strong>the</strong> greatest distinction in <strong>the</strong> subject Conflict <strong>of</strong> Laws in that examination.<br />

HERCHEL SMITH FELLOWSHIP FUND<br />
1. The sum <strong>of</strong> £17.25m bequea<strong>the</strong>d to <strong>the</strong> <strong>University</strong> by <strong>the</strong> late Dr Herchel Smith to support<br />
postdoctoral research at <strong>Cambridge</strong> shall form a fund called <strong>the</strong> Herchel Smith Fellowship Fund. The<br />
income from <strong>the</strong> Fund shall be used for <strong>the</strong> purpose <strong>of</strong> providing <strong>the</strong> stipends, national insurance,<br />
pension contributions, and indirect costs <strong>of</strong> such number <strong>of</strong> Herchel Smith Fellows as shall be<br />
determined from time to time by <strong>the</strong> Managers <strong>of</strong> <strong>the</strong> Fund, such expenses incurred by <strong>the</strong> Fellows as<br />
may be approved by <strong>the</strong> Managers, and expenses connected with <strong>the</strong> administration <strong>of</strong> <strong>the</strong> Fund.<br />
2. The Fund shall be administered, and <strong>the</strong> Fellows elected, by a Board <strong>of</strong> Managers consisting <strong>of</strong>:<br />
(a) one person each appointed by <strong>the</strong> Schools <strong>of</strong> <strong>the</strong> Biological Sciences and <strong>the</strong> Physical Sciences;<br />
(b) two persons appointed by <strong>the</strong> General Board, one <strong>of</strong> whom shall be Chairman.<br />
3. The Managers shall give not less than three months’ notice <strong>of</strong> <strong>the</strong>ir intention to proceed to an<br />
election. They shall be empowered to indicate in <strong>the</strong>ir Notice that for election in any particular year<br />
preference will be given to candidates working in a specific field or fields. If in any year, whatever<br />
<strong>the</strong> number <strong>of</strong> vacancies, in <strong>the</strong> Managers’ opinion <strong>the</strong>re are no suitable candidates, <strong>the</strong>y shall not be<br />
bound to make an election.<br />
4. A graduate <strong>of</strong> any university, but normally excepting <strong>the</strong> Universities <strong>of</strong> <strong>Cambridge</strong> and Harvard,<br />
who is <strong>of</strong> postdoctoral or equivalent status shall be eligible to apply for a Fellowship provided that a<br />
Fellow shall have been awarded his or her Ph.D. Degree, or equivalent, not more than three years<br />
before <strong>the</strong> date on which tenure <strong>of</strong> <strong>the</strong> Fellowship will commence.<br />
5. The Fellowship shall be tenable for at least two but not more than three years and shall not be<br />
renewable.<br />
6. It shall be <strong>the</strong> duty <strong>of</strong> a Fellow to undertake full-time research in a subject approved by <strong>the</strong><br />
Managers within <strong>the</strong> fields <strong>of</strong> Pure Ma<strong>the</strong>matics, Physics, Organic Chemistry, Biochemistry, or<br />
Molecular Biology, or in related fields in <strong>the</strong> Experimental Natural Sciences (but excluding <strong>the</strong> History<br />
and Philosophy <strong>of</strong> Science). The research work shall be carried out in <strong>Cambridge</strong> (unless in special<br />
circumstances <strong>the</strong> Managers give leave for it to be carried out elsewhere) and shall be subject to such<br />
conditions as <strong>the</strong> Managers may impose. In any books, papers, or o<strong>the</strong>r publications containing <strong>the</strong><br />
results <strong>of</strong> investigations carried out during <strong>the</strong> tenure <strong>of</strong> <strong>the</strong> Fellowship, <strong>the</strong> Fellow shall, where<br />
practicable, use <strong>the</strong> title ‘Herchel Smith Fellow’.<br />
7. A Fellow may, with <strong>the</strong> permission <strong>of</strong> <strong>the</strong> Managers, undertake not more than six hours’ teaching<br />
work a week for remuneration without suffering any deduction from <strong>the</strong> stipend <strong>of</strong> <strong>the</strong> Fellowship.<br />
8. The annual stipend <strong>of</strong> a Fellow shall be such sum as shall be determined by <strong>the</strong> Managers, within<br />
a range approved from time to time by <strong>the</strong> Council.<br />
9. The Managers shall make grants from <strong>the</strong> Fund to cover <strong>the</strong> expenses incurred in <strong>the</strong> appointment<br />
<strong>of</strong> <strong>the</strong> Fellows. They shall also be empowered to make grants for purposes in support <strong>of</strong> a Fellow’s<br />
research, provided that <strong>the</strong> income <strong>of</strong> <strong>the</strong> Fund is capable <strong>of</strong> bearing such a charge.<br />
10. The Managers may make <strong>the</strong> payment <strong>of</strong> <strong>the</strong> stipend <strong>of</strong> a Fellow, or <strong>of</strong> an instalment <strong>of</strong> <strong>the</strong><br />
stipend, conditional on <strong>the</strong>ir approval <strong>of</strong> a report from <strong>the</strong> Fellow on <strong>the</strong> progress <strong>of</strong> his or her research.<br />
The Managers may delegate <strong>the</strong> consideration <strong>of</strong> a Fellow’s report to one or more <strong>of</strong> <strong>the</strong>mselves. The<br />
Managers may terminate <strong>the</strong> tenure <strong>of</strong> a Fellow at any time if, in <strong>the</strong>ir opinion, he or she is unfit to<br />
continue to hold <strong>the</strong> Fellowship.<br />
11. A Fellow shall inform <strong>the</strong> Managers <strong>of</strong> <strong>the</strong> award <strong>of</strong> any o<strong>the</strong>r emolument or his or her intention<br />
to undertake work o<strong>the</strong>r than work approved by <strong>the</strong> Managers in accordance with Regulations 6 and<br />
7. On receiving such information <strong>the</strong> Managers shall consider whe<strong>the</strong>r a reduction should be made in<br />
<strong>the</strong> amount <strong>of</strong> <strong>the</strong> Fellow’s stipend.<br />
12. After provision has been made for <strong>the</strong> Fellowships in accordance with Regulations 1 and 9, any<br />
unexpended income <strong>of</strong> <strong>the</strong> Fund in a financial year may, at <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> Managers:<br />
(a) be added to <strong>the</strong> capital <strong>of</strong> <strong>the</strong> Fund;<br />
(b) be accumulated for use as income in subsequent years;<br />
