3.1. รัฐบาลทหาร
ผู้นำการปฏิวัติ พลเอกสนธิ บุญยรัตกลินเสนอชื่อ
พลเอกสุรยุทธ์ จุลานนท์ องคมนตรี8 เป็นนายกรัฐมนตรี
และได้รับการแต่งตั้งให้ดำรงตำแหน่งตามคาด คณะ
รัฐมนตรีที่พลเอกสุรยุทธ์เลือกสรรมาล้วนมีแต่กลุ่ม
ผู้เชี่ยวชาญและนักวิชาการ รัฐบาลนี้แตกต่างจาก
รัฐบาลนายอานันท์ในช่วง พ.ศ. 2534 - 2535 ที่ได้รับ
การแต่งตั้งเป็นนายกรัฐมนตรีหลังการรัฐประหารเหมือนกัน
นายอานันท์ทำการปฏิรูปกฎหมายต่างๆ มากมาย แต่
พลเอกสุรยุทธ์เลือกวิธีที่ระมัดระวังกว่า เหมือนเขามอง
ว่าบทบาทของรัฐบาลนี้คือรักษาการณ์ชั่วคราวจนกว่า
รัฐธรรมนูญฉบับใหม่จะผ่านและมีการเลือกตั้งใหม่
รัฐบาลนี้ตั้งเป้าหมายน้อย ผลงานจึงน้อยตาม บางส่วน
ของผลงานคือจัดการค่าใช้จ่ายนอกงบประมาณของ
รัฐบาลทักษิณที่หมกอยู่ตามธนาคารและที่ต่างๆ เคลียร์
ข้าวปริมาณมหาศาลในสต็อก และปรับราคารับซื้อข้าว
ของรัฐบาลลงให้ใกล้เคียงกับราคาตลาด นอกจากนั้น
สภานิติบัญญัติแห่งชาติที่กองทัพแต่งตั้งขึ้นยังได้ผ่าน
กฎหมายหลายฉบับที่มีประโยชน์ เช่น พ.ร.บ.ธนาคาร
แห่งประเทศไทยฉบับใหม่ที่ได้กล่าวถึงก่อนหน้านี้ รวม
ถึง พ.ร.บ.สถาบันคุ้มครองเงินฝาก และ พ.ร.บ.ธนาคาร
พาณิชย์ฉบับใหม่
ผลงานสำคัญของรัฐบาลนี้คือดำเนินคดีกับบรรดา
พรรคการเมืองในระบอบเก่า ทั้งพรรครัฐบาลในเวลา
นั้น (ไทยรักไทย) และพรรคประชาธิปัตย์ที่เป็นฝ่ายค้าน
ต่างถูกสั่งฟ้องในข้อหาทุจริตการเลือกตั้งเดือนเมษายน
พ.ศ. 2549 ไทยรักไทยถูกตัดสินว่าผิดแต่ประชาธิปัตย์
ได้รับการยกฟ้อง ข้อกำหนดที่น่ากังขาในกฎหมาย
ฉบับใหม่ที่ประกาศใช้โดยรัฐบาลทหารและนำมาใช้โดย
มีผลย้อนหลัง คือเมื่อพรรคการเมืองถูกตัดสินว่าผิดจริง
ในกรณีใดก็ตาม และมีผู้ใดผู้หนึ่งในคณะกรรมการ
บริหารพรรครู้เห็นในความผิดนั้น กรรมการบริหาร
พรรคทั้งหมดจะต้องร่วมรับผิดชอบ และถูกตัดสิทธิ์
ทางการเมืองเป็นเวลา 5 ปี ในกรณีของพรรคไทยรักไทย
มีกรรมการบริหารพรรคเพียงคนเดียวที่พบมูลความผิด
แต่ตามกฎหมายใหม่ คณะกรรมการบริหารพรรคทุกคน
2.5 Thaksin’s fall
Despite widespread corruption, the general election
in February 2005 was an overwhelming victory for the Thai
Rak Thai, Thaksin’s party. It won 375 out of the 500 seats,
as compared to the 248 seats that it won in 2001. That
was the beginning of Thaksin’s downfall, for it convinced
some important people that Thailand was heading for
a totalitarian state under Thaksin.
The man who shot the first salvo against Thaksin was
an unlikely person: Sondhi Limthongkul, a newspaper
publisher, an owner of a satellite television channel, and
a former crony of Thaksin’s. First, Sondhi began to speak
out against the corruption in Thaksin’s government in his
show on state television, a slot he had acquired because
of his friendship with Thaksin. As he became more
outspoken, he was removed from that slot, whereupon he
shifted his venue to a hall in a public park, and later to
Thammasat University which began to see increasing
crowds attending his show which occurred every Friday
evening.
If left to itself, Sondhi’s show would probably have
fizzled out, but then Thaksin handed it a gift. In January
2006, Thaksin announced, out of the blue, that he was
selling Shin Corporation, the core of his business empire,
which also owned the mobile-phone concessionaire,
Advanced Info Services, to Temasek, the Singaporean
state-owned investment company. Shin Corporation also
owned Shin Satellite, which had the satellite concessions
as well. The sale gave Thaksin and his family 72 billion
baht ($1.90 billion), on which he paid no tax. It was bad
enough to sell to foreigners a company using part of the
spectrum as well as the satellite orbit which had been
allocated to Thailand, both of which are therefore
considered national treasures. But it was the fact that no
taxes were paid, despite a large number of cross-transactions
between his wife, his children, and shell companies in the
British Virgin Islands that galled many people.
Sondhi found that his crowds were getting larger and
larger. He allied himself with a number of civil society
