ผลงานสำคัญอีกชิ้นของรัฐบาลจากการรัฐประหาร<br />
คือการกำหนดกรอบรัฐธรรมนูญฉบับใหม่ ซึ่งเป็น<br />
ฉบับที่ 17 ของประเทศในระยะเวลา 75 ปี<br />
3.2 รัฐธรรมนูญ พ.ศ. 2550<br />
รัฐธรรมนูญฉบับใหม่ร่างโดยคณะกรรมาธิการยกร่าง<br />
รัฐธรรมนูญที่แยกออกมาจากสภานิติบัญญัติ โดยมี<br />
ความแตกต่างจากฉบับเก่าหลายประการ<br />
• กลับมาใช้ระบบเลือกตั้งแบบแบ่งเขตเหมือนก่อน<br />
พ.ศ. 2540 เพื่อป้องกันไม่ให้พรรคหนึ่งพรรคใดมี<br />
โอกาสได้เสียงข้างมากในรัฐบาล<br />
• ตุลาการมีบทบาทสำคัญและมีสิทธิ์มีเสียงมากขึ้น<br />
ทั้งในองค์กรอิสระและศาลรัฐธรรมนูญ<br />
• ตุลาการมีอำนาจมากขึ้นในการเอาผิดทั้งนักการเมือง<br />
ที่ประพฤติมิชอบและตัวพรรคการเมืองเอง ตามที่<br />
เคยอธิบายไปก่อนหน้า<br />
• ประชาชนและประชาคมมีสิทธิเพิ่มขึ้นในหลายด้าน<br />
Chamlong Srimuang, and set up the People’s Alliance for<br />
Democracy (PAD), later to become popularly known as<br />
the Yellow Shirts. In February 2006, they marched on<br />
Government House demanding that Thaksin resign.<br />
Thaksin instead dissolved the parliament, saying that PAD<br />
threatened disorder. From this point on to his ultimate<br />
downfall, he was an acting prime minister.<br />
If Thaksin expected the return to the people to settle<br />
the issue vis-à-vis his opposition, it was not to be. The<br />
opposition boycotted the election, knowing full well that<br />
Thaksin would win the elections, although they claimed<br />
that the real reason Thaksin would win was because<br />
he would buy the election because the Electoral Commission<br />
was already in his pocket. Thaksin nevertheless went<br />
ahead with the elections. The elections on April 7 brought<br />
about a flurry of lawsuits concerning possible fraudulent<br />
practices, until the King stepped in and said in a speech<br />
to the judges on April 25 that there could not be a onesided<br />
election, and that it was up to the judges to help<br />
resolve the issue. This speech inaugurated the judicial<br />

กลับคืนมา ผู้น ำการรัฐประหารสัญญาว่าจะมีการท ำประชามติ<br />
สำหรับรัฐธรรมนูญฉบับใหม่ และผลประชามติที่ออกมา<br />
คือข้อบ่งชี้ถึงการแบ่งแยกระหว่างเสื้อแดงและเสื้อเหลือง<br />
ภาคเหนือและภาคอีสานส่วนใหญ่ รวมถึงบางพื้นที่ใน<br />
กรุงเทพฯ โหวตไม่เห็นด้วยกับรัฐธรรมนูญ แต่รัฐธรรมนูญ<br />
ฉบับนี้ก็ยังผ่านด้วยคะแนนเสียง 56 ต่อ 44 เปอร์เซ็นต์<br />
นับว่าฉิวเฉียดกว่าที่กลุ่มผู้นำการรัฐประหารหวังเอาไว้<br />
3.3 ชัยชนะของระบอบทักษิณ<br />
หากผู้ร่างรัฐธรรมนูญหวังว่าจะป้องกันไม่ให้ผู้สืบทอด<br />
ของทักษิณขึ้นสู่อ ำนาจ พวกเขาก็ต้องผิดหวังในการเลือกตั้ง<br />
พ.ศ. 2551 ภายใต้รัฐธรรมนูญฉบับใหม่ ผลปรากฏว่า<br />

In the end, it was not the judges who brought down<br />
Thaksin, but the military. On September 19, 2006, a namesake<br />
of the Yellow Shirt leader, General Sonthi Boonyaratakalin<br />
staged a coup d’etat and tore up the 1997 Constitution.<br />
3. AFTER THAKSIN<br />
3.1 The military government<br />
The coup leader,General Sonthi, nominated General<br />
Sorrayuth Chulanont, a Privy Councillor, 8 to be Prime<br />
Minister, and the latter was duly appointed.General Sorrayuth<br />
selected as hisMinisters a cabinet of technocrats and<br />
academics. Unlike Anand in 1991–1992, who was also<br />
appointed prime minister following a coup d’etat, and who<br />
then proceeded to introduce a vast amount of reform<br />
