The Physic<strong>al</strong> Prejudice<br />

Abstract. The prejudice represents a condition in the absence of<br />

which the civil liability cannot be conceived within the accelerated rhythm of<br />

the <strong>de</strong>velopment of nowadays society. Any mo<strong>de</strong>rn attempt to classify<br />

prejudices inclu<strong>de</strong>s injuries caused to a natur<strong>al</strong> person’s he<strong>al</strong>th and physic<strong>al</strong><br />

or psychic<strong>al</strong> integrity; the consequences usu<strong>al</strong>ly being both pecuniary and<br />

mor<strong>al</strong>. The current Romanian Civil Co<strong>de</strong> does not expressly regulate the<br />

forms of the prejudices that can be compensated. However, the jurispru<strong>de</strong>nce<br />

and the literature on the matter have dwelt upon, at length, the notion of<br />

physic<strong>al</strong> prejudice and the variety of physic<strong>al</strong> damages – loss of leisure,<br />

esthetic prejudice, pretium doloris.<br />

The new Civil Co<strong>de</strong> regulates, in distinct texts, the materi<strong>al</strong> (economic)<br />

compensation, subsequent to any injury, as well as that for the non-patrimoni<strong>al</strong><br />

losses in case of damages caused to the physic<strong>al</strong> integrity or he<strong>al</strong>th, for<br />

reductions in a person’s possibilities of soci<strong>al</strong> and family life. This represents a<br />

start, which beyond doubt, will ground a necessary theory of the physic<strong>al</strong><br />

prejudice, especi<strong>al</strong>ly from the perspective of compensating the victims.<br />

PRIVIND PREJUDICIUL CORPORAL<br />

Una din <strong>de</strong>finiţiile consacrate prejudiciilor nepatrimoni<strong>al</strong>e operează<br />

diviziunea prejudicii cauzate person<strong>al</strong>ităţii fizice, prejudicii cauzate<br />

person<strong>al</strong>ităţii afective şi prejudicii cauzate person<strong>al</strong>ităţii soci<strong>al</strong>e 1 .<br />
