An Ottoman Scholar’s Philological and Jurisprudential Approach to the Grammatical Exception
[A Study of Tashkoprizadah’s Risâlatu’l-İstiksâ fî Mabâhihithi’l-İstithnâ]
When the works that Tashkoprizadah –who lived between 1495-1561 and held several important scholarly positions
during his lifetime- read during his studies and later himself taught as a lecturer are examined, it can easily be seen
that he had extensive knowledge in the Islamic sciences. Alongside his duties at the Ottoman madrasahs, he was a very
prolific author who compiled many different works and around thirty treatises in the disciplines of kalam, fiqh, tafseer,
ethics, logic, biography, Arabic language and literature, history of sciences and medicine, all in Arabic. One of his most
important works related to philology, about which he authored around twenty treatises, is the treatise named Risâletü’l-İstiksâ
fî Mebâhisi’l-İstisnâ in which he studies the subject of the grammatical exception in the Arabic language, from both
linguistic and legal viewpoints. Related to the reason for authoring this treatise, in the introduction, Tashkoprizadah states
that an inspiration came to him which conveyed to him that a work about the grammatical exception was indispensable.
Because knowing the content of the profession of faith which is the source of all which is good and blissful, is only possible
if the grammatical exception is completely grasped. The treatise, which consists of an introduction (mukaddimah), five
chapters (maksad) and a conclusion, deals with the foundations of the grammatical exception in logic and ilm al-wad’, and
follows a comparative approach between the views of the grammarians and the jurists. The reason that the exception, which
is basically an Arabic grammar term meaning excluding something from the general rule, has been extensively studied by
grammarians as well as by jurists, is not only that most jurists were also well trained philologians, but also because of its’
close relation to subjects in jurisprudence such as wad’, bayan, truth (hakikat), metaphor, takhsis and naskh.
