İctihad Bahisleri Bağlamında Osmanlı Usul Düşüncesinin Özgünlüğü Problemi
Osmanlı Devleti’nin kuruluşundan itibaren usul-i fıkıh alanında verilen pek çok eser, bir “Osmanlı usul düşüncesi”
kavramından söz etmeyi mümkün kılmaktadır. Hanefî mezhebine bağlı Osmanlı ulemasının, usul-i fıkıh alanında özgün
yaklaşımlarının olup olmadığı ancak önceki dönem Hanefî âlimlerinin usul eserleriyle yapılacak bir mukayese ile ortaya
konulabilir. Bu tebliğde Osmanlı dönemindeki usul düşüncesini temsil kabiliyeti yüksek olan eserlerin ictihad bahisleri ile
önceki dönem Hanefî usul eserlerinin ictihad bahisleri mukayese edilerek değerlendirmelerde bulunulacaktır.
The Problem of Originality of Ottoman Usul Thought with Special Reference to Ijtihad Subjects
The numerous Works that are given in the usul-i fiqh discipline in the time of Ottoman Empire make us possible
to mention “Ottoman usul thought”. The only way to state that the Ottoman scholars whether had original approaches in
usul-i fiqh discipline or not is to compare their Works with those are written in the previous period. In this study we will try
to compare the usul-i fiqh books that are written in the Ottoman era with those that are written previously with reference to
the ijtihad subjects and will try to make some evaluations.
