Fakıyân-ı Rûm: Osmanlı Erken Döneminde Fakihler<br />
Osmanlı Devleti’nin kuruluş döneminde önemli fonksiyon icra eden zümreler arasında gösterilebilir. Din bilgini<br />
yahut fıkıh ilminde âlim kimseler olan fakihler, genellikle Suriye ve Mısır’da fıkıh, tefsir vs. eğitimi aldıktan sonra<br />
Anadolu’ya gelerek yeni oluşmakta olan siyasî teşekküllerde kadılık vazifesini üstlenmiş, daha önce yaşadıkları devletler<br />
bünyesinde edindikleri siyasî tecrübelerini yeni kurulmakta olan beyliklere aktarmış şahsiyetlerdir. Osmanlı Beyliğinin ilk<br />
yıllarında bunun en iyi bilinen örneği devletin bağımsızlık hutbesini okuduğu ifade edilen Dursun Fakih’tir.<br />
Gerek Osmanlı öncesi dönemde gerekse Osmanlı Devleti’nin kuruluş döneminde devlet bünyesinde yahut sosyal<br />
hayatta fakih unvanı taşıyan pek çok şahsiyetin mevcudiyeti, kendilerine ait çok sayıda vakıf ve mülk bulunması, vergiden<br />
muaf tutulmaları gibi fakihlerin gâziler, abdallar ve ahiler gibi başlı başına bir zümre olarak ele alınıp değerlendirilmesini<br />
zaruri kılmaktadır. Kuruluş dönemindeki fakihlerden bazılarının, Dursun Fakih örneğinde görüldüğü üzere devlet<br />
kademelerinde en üst makamlarda yer aldığı görülürken, pek çoğunun da sadece bir cami imamı veya müezzini olarak<br />
görev yaptıkları görülmektedir. Muhtemelen bu sebepten olsa gerek, kuruluş döneminde faaliyet gösteren “fakih” yahut<br />
halk dilindeki söyleyişle “fakı” unvanını taşıyan bu şahsiyetlerin daha ziyade imamlar olarak kabul edildikleri anlaşılmaktadır.<br />
Fakihler görevleri sayesinde dönemin toplumsal hayatında bir sivil toplum önderi vazifesi görmüşlerdir. Kırsal kesimde<br />
ise görevlerine köprü tamiri, kapanan derelerin açılması gibi daha halka dönük görevlerinin eklendiği de anlaşılmaktadır.<br />
Bu tebliğde Osmanlı erken döneminde isimleri ve entelektüel kişilikleri ile öne çıkan Dursun Fakih, İshak Fakih,<br />
Yahşi Fakih gibi isimler merkezinde, fakihlerin/fakıların faaliyetleri irdelenmeye çalışılacak, sosyal ve siyasi hayat içerisinde<br />
üstlendikleri fonksiyonlar hakkında bilhassa vakfiyeler ve tahrir kayıtları esas alınarak değerlendirmelerde bulunulacaktır.<br />
Fakıyân-ı Rûm: Fuqaha in the Period of the Establishment of Ottoman Empire<br />
Fuqaha class may be regarded as one of the functional communities in the period of the establishment of Ottoman<br />
Empire. As Religious scholars or experts on Islamic Law, Fuqaha, were mostly getting their education in Syria and<br />
Egypt on Fiqh, Tafsir etc., then leave for Anatolia to get into political organizations to carry out the duty of being a Qadi.<br />
Thereby, they were employing their experiences of politics which were taken in former states they had been in, for newly<br />
established principalities. Dursun Faqih is one of the well-known individual who was the one to give the Independence<br />
Sermon of the State in the early years of Ottoman Principality.<br />
Either in the previous period, or in the establishment period of Ottoman State, presence of many individuals who<br />
hold the title of “Faqih” either within the body of the State or in social life; to have possessions of many waqfs and properties;<br />
and being free of taxes make it obligatory to approach the Fuqaha independently as in veterans, wandering dervishes<br />
and ahi community. While some of the fuqaha from the establishment period, as seen in the example of Dursun Faqih, may<br />
be seen among high rank authority, a good number of them only served as İmam or Muezzin in mosques. Probably by this<br />
reason, we understand that those who hold the title of Faqih or as in public language “fakı” in the establishment period had<br />
been rather seen as İmams. Due to their important mission, Fuqaha were considered as leaders of civil society in the social<br />
life of the period. More than that, in the countryside, their mission involved more communal tasks such as repairing bridges<br />
or un-blocking river streams.<br />
In this presentation, activities of Fuqaha will be analyzed, based on the people like Dursun Fakih, İshak Fakih and<br />
Yahşi Fakih who were featured by their names and intellect in early Ottoman period; and their role in social and political<br />
life, exclusively by taken waqfs and tahrir registers into consideration as basis.<br />
