If a bidder requests a pre-bid approval of a substitution, data required to make an evaluation must be received no later than six working days before the bid opening date. If the substitution is acceptable, it will be identified in an addendum to all Bidders. 7.00 - ARTICLE 7 - PRE-BID CONFERENCE AND SITE TOUR A. A Mandatory Pre-Bid Conference will be held at 1:00 p.m. on Wednesday, September 7, 2011 at Federal Express, 1 Sally Ride Way, Oakland, California. B. A pre-bid site tour will be held at the Pre-Bid Conference. C. Prospective bidders shall be allowed to bring a maximum of three representatives to the pre-bid conference. D. All attendees must bring at least one form of government issued photo identification to gain access into the facility for the meeting and to gain access to visit the site. E. Prospective bidders must respond to <strong>TranSystems</strong> (Adam Ojeda, aaojeda@transystems.com) on or before September 1, 2011 regarding confirmation of attendance at the pre-bid conference. At this time, provide the names of all attendees that the firm that each represents. 8.00 - ARTICLE 8 - BID FORM A. Submit Bid on the form provided (Section 00300 - Bid Form), properly executed and with all items filled in. Bids shall include all applicable federal, state and local taxes. B. A Bid Bond in the amount specified in the Notice to Bidders is required and shall be issued by a Surety acceptable to Federal Express and licensed to do business in the state of the location of the Work.. The bond shall be made payable to Federal Express. B. The attorney in fact who executes the Bid Bond on behalf of the Surety shall attach a certified and current copy of his power of attorney. C. Federal Express has the right to retain the Bid Bond of Bidders to whom an award is being considered until: 1. The Contract has been executed; or 2. The specified time has elapsed so that Bids may be withdrawn; or 3. All Bids have been rejected. D. If the Bidder refuses to enter into contract or fails to furnish the required attachments properly executed, the amount of the Bid Bond shall be forfeited to Federal Express as liquidated damages, not as a penalty. 10.00 - ARTICLE 10 - MODIFICATION AND WITHDRAWAL OF BIDS A. Before the time and date designated for receipt of Bids, Bids may be withdrawn only by written request, signed by a person legally authorized to bind the Bidder to a contract. B. Withdrawn Bids may be resubmitted until the time designated for receipt of Bids provided that they fully conform to the Bidding Requirements. C. Bids may not be modified, withdrawn or canceled by the Bidder during the stipulated time period following the Bid opening.
