Chapter 3: Zoning DistrictsSECTION 3.8: OVERLAY ZONING DISTRICTSSubsection 3.8.5: Airport Overlay (AO) District(b)(c)Lighting that makes it difficult for pilots to identify airport lights,results in glare in the eyes of pilots using the airport, impairs visibilityin the vicinity of the airport, or otherwise endangers or interferes withthe landing, takeoff, or maneuvering of aircraft intending to use theairport is prohibited.The provisions of this subsection shall not apply to airport lightingused for navigational purposes in accordance with Federal AviationAdministration requirements.(2) Interference(a) Electronic impulses or signals that interfere with radiocommunications between aircraft and the airport or that interferewith established navigation aids are prohibited.(b) Any operation or use that emits smoke, dust, visible fumes or vaporsinto the atmosphere that would interfere with the safe navigation ofaircraft using the airport is prohibited.(3) Disclosures(a)(b)CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCEFinal subdivision plats, master plans, site plans, or any other documentfiled as part of any approval process with <strong>Currituck</strong> <strong>County</strong> shallcontain the following disclosure statement: “All or a portion of thisproperty lies within the Airport Overlay District. Persons on thepremises may be exposed to noise and other effects as may beinherent in airport operations. <strong>Currituck</strong> <strong>County</strong> has placed certainrestrictions on development and use of property within this overlay.”Real estate transactions involving lands either wholly or partiallylocated within the Airport Overlay District shall give full writtendisclosure of the restrictions on development and use of propertywithin this overlay to the prospective purchaser in accordance withthe N.C. Residential Property Disclosure Act (NCGS 47E). AnAirport Overlay Disclosure Form is available in the AdministrativeManual.(4) Multimodal TransportationPrior to the issuance of any permit for development, parcels abutting US 158shall reserve a 20 foot public access easement along the property line adjoiningthe roadway.(5) Natural Resources(a)(b)(c)In no case shall hazardous materials or other harmful substances bestored, handled, treated, used, produced, recycled, or disposed of in away that would pose a significant hazard to any surface orgroundwater resource.The development and use of land shall meet the requirements of the<strong>Currituck</strong> <strong>County</strong> Wellhead Protection Plan. Any use or activitydetermined by the Planning Director to pose a significant groundwaterhazard to the county’s mainland public water supply shall beprohibited.Stormwater management facilities shall be designed, engineered,constructed, and maintained to detract waterfowl.
