CHAPTER 7.ENVIRONMENTALPROTECTION7.1. OPEN SPACE SET-ASIDES7.1.1. Purpose and IntentThe purpose of this section is to:A. Establish the standards under which residential and mixed-use development shall setaside a portion of the development area as open space;B. Distinguish between the characteristics, requirements, and appropriate locations foropen space set-asides; andC. Establish minimum ownership and maintenance standards for homeowner andproperty owner associations related to open space set-asides.7.1.2. ApplicabilityA. GeneralUnless exempted by Section 7.1.2.E, Exemptions, the provisions of this section shallapply to all residential and residential portions of mixed-use development in thecounty.B. Time of ReviewReview for compliance with these standards shall occur during review of a site plan(see Section 2.4.7), subdivision (see Section 2.4.8), or planned development masterplan (see Section 2.4.5), as appropriate.C. Existing <strong>Development</strong>Unless redeveloped, the standards in this section shall not apply to developmentexisting prior to January 1, 2013. Redevelopment conducted after January 1, 2013shall comply with the standards in this section, to the maximum extent practicable, andshall provide its pro rata share of open space set-aside.D. Conservation SubdivisionsOpen space set-asides associated with a conservation subdivision shall be subject tothe standards in Section 6.4, Conservation Subdivision.E. ExemptionsThe following forms of development shall be exempted from the standards in thissection:(1) <strong>Development</strong> of a single-family detached or two- to four-family dwelling on aplatted lot in existence on January 1, 2013; and(2) Subdivisions with fewer than 6 lots.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE7.1
