Chapter 2: AdministrationSECTION 2.4: SPECIFIC REVIEW PROCEDURESSubsection 2.4.4: Conditional Rezoning(7) Would result in a logical and orderly development pattern;(8) Would result in significant adverse impacts on the natural environment—including, but not limited to, water, air, noise, stormwater management,wildlife, vegetation, wetlands, and the natural functioning of the environment;(9) Would result in development that is adequately served by public facilities (e.g.,streets, potable water, sewerage, stormwater management, solid wastecollection and disposal, schools, parks, police, and fire and emergency medicalfacilities);(10) Would not result in significantly adverse impacts on the land values in thesurrounding area; and(11) Would not conflict with the public interest, and is in harmony with thepurposes and intent of this <strong>Ordinance</strong>.D. Designation on Official Zoning MapThe Planning Director shall enter changes onto the Official Zoning Map promptly afterapproval of a map amendment application by the Board of Commissioners.E. EffectApplicable (see Section 2.3.13).F. AmendmentApplicable (see Section 2.3.14).G. ExpirationApproval of an Official Zoning Map amendment shall not expire, but the amendedOfficial Zoning Map is subject to further amendment in accordance with the mapamendment procedures set forth in this section.2.4.4. Conditional RezoningA. PurposeThe purpose of this section is to provide a uniform means for amending the OfficialZoning Map to establish conditional zoning districts. In cases where the standards of ageneral use zoning district are inadequate to ensure that development allowed by thedistrict will conform to the county’s adopted plans or to appropriately address theimpacts expected to be generated by development, a landowner may apply for aconditional rezoning. The conditional rezoning establishes a parallel conditional zoningdistrict that is equivalent to a corresponding general use zoning district, but is subjectto additional conditions or restrictions that the applicant and county mutually agreeare necessary to ensure conformance to adopted plans and adequately addressexpected development impacts.B. Applied to Entire SiteApplications for conditional rezoning submitted after January 1, 2013 shall include allthe land area within a recorded lot or site that is the subject of the application.Conditional rezoning applications may not establish bi-furcated zoning classificationswhere only a portion of a lot or site is subject to a conditional zoning classification.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.33
